AN ACT to amend the Town Planning and Develop-

ment Act, 1928-1958.

[Assented to 20th November, 1959.]

BE it enacted by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Council and the Legislative Assembly of Western Australia, in this present Parliament assembled, and by the authority of the same, as follows:—

Short title

and citation. 1. (1) This Act may be cited as the Town Planning and Development Act Amendment Act (No. 3), 1959.

2. The interpretation, "building line" in section amended.

two of the principal Act is amended by substituting for the passage, " 'building line' means a line fixed by a local authority and shown on a plan for a town planning scheme approved by the Minister," in the first three lines the following passage

"building line" means a line fixed by a local authority or The Metropolitan Region Planning Authority constituted under the provisions of the Metropolitan Region Town Planning Scheme Act, 1959, as the case may be, and shown on or described in a plan for a town planning scheme approved by the Minister or the Metropolitan Region Scheme made under that Act.

Paragraph (a) of subsection (3) of section seven A of the principal Act is amended by substituting for the words, "one thousand nine hundred and fifty-nine" in lines five and six, the words, "one thousand nine hundred and sixty-one."	amended.

4. The Third Schedule to the principal Act is Schedule, amended.

(a)	by deleting the names, "Nedlands" and "South Perth" from the list of names appearing under the h e a din g, "Road Districts";
(b)	by adding the names, "Nedlands" and "South Perth" after the name, "Subiaco," to the list of names appearing under the heading, "Municipalities"; and
(c)	by adding the name "Cockburn" after the name, "Canning," to the list of names appearing under the heading, "Road Districts."
