AN ACT to amend the Town Planning and

Development Act, 1928-1972.

[Assented to 6th June, 1973.]

RE it enacted by the Queen's Most Excellent

Majesty, by and with the advice and consent of the Legislative Council and the Legislative Assembly of Western Australia, in this present Parliament assembled, and by the authority of the same, as follows:-

1. (1) This Act may be cited as the Town Short title

2. Section 2 of the principal Act is amended

(a)

by substituting for the interpretation "Commissioner" an interpretation as f ol- lows

"Commissioner" means the Town Plan- ning Commissioner appointed pur- suant to section 3 of this Act, and includes the Deputy Commissioner while he is, pursuant to that section, acting in the place of the Commis- sioner; ; and

(b)

by adding before the interpretation "devel- opment" an interpretation as follows

"Deputy Commissioner" means the Deputy Town Planning Commis- sioner appointed pursuant to section three of this Act; .

(4) The duties of the Deputy Commissioner shall include acting in the place of the Commissioner while the Commissioner is sick or absent, or is otherwise incapacitated, or when from any cause the office of Commis- sioner is vacant.

(5) The Deputy Commissioner, while acting in the place of the Commissioner, shall have all the powers and authorities of, and all the protection given to, the Commissioner, and shall perform the duties of the Commissioner.

(6) Any act, matter, or thing, for or with respect to which provision relating to the Commissioner or Deputy Commissioner is made in this Act, made, done, or executed before the

coming into operation of the Town Planning and Development Act Amendment Act, 1973 which would have been lawful if that Act had been in force at the time such act, matter, or thing was made, done, or executed is hereby validated.
