AN ACT to amend the Town Planning and Develop-

ment Act, 1928-1956.

[Assented to 6th December, 1957.]

BE it enacted by the Queen's Most ExcellentMajesty, by and with the advice and consent of the Legislative Council and the Legislative Assembly of Western Australia, in this present Parliament assembled, and by the authority of the same, as follows:—

1. (1) This Act may be cited as the Town Plan-

ning and Development Act Amendment Act, 1957.

(2) In this Act the Town Planning and Develop-

ment Act, 1928-1956,

Act No. 39 of 1928 as reprinted with amendments to and including Act No. 79 of 1956 incorporated pursuant to the provisions of the Amendments Incorporation Act, 1938,

is referred to as the principal Act.

(3) The principal Act as amended by this Act may be cited as the Town Planning and Development Act, 1928-1957.

principal Act is amended by substituting for the words, "one thousand nine hundred and fifty-seven" in lines five and six of paragraph (a), the words, "one thousand nine hundred and fifty-eight".

3. Section thirteen of the principal Act is

(a)

by adding after the section designation, "13" the subsection designation, "(1)";

(b)

by adding after the passage, "Public Works Act, 1902-1945" in paragraph (b) the passage, "(but subject to subsection (2) of this section)"; and

(c)

by adding a subsection as follows:

(2) When any land is taken compul- sorily under the powers conferred by this section the provisions of

(a)

subsections (2) to (7) inclusive of section seventeen; and

(b) section seventeen A;

of the Public Works Act, 1902-1956 shall not apply to or in respect of the land or the taking or in any manner whatsoever, and that Act shall be read and construed as if the said provisions were deleted.
