Tow Truck Industry (Transitional) Regulation 1999

Tow Truck Industry Act 1998

His Excellency the Governor, with the advice of the Executive Council, has made the following Regulation under the Tow Truck Industry Act 1998.

Explanatory note

This Regulation is consequential on the abolition of the Tow Truck Industry Council (“the former corporation”) by the Tow Truck Industry Act 1998 (“the new Act”) and the commencement of certain administrative provisions of that Act relating to the constitution of the Tow Truck Authority (which replaces the former corporation). The purpose of this Regulation is to enable the Authority to exercise the functions of the former corporation under the Tow Truck Act 1989 until such time as the Authority’s functions under the new Act, and the operational provisions of the new Act, are commenced.

This Regulation is made under the Tow Truck Industry Act 1998 (including clause 1 of Schedule 2). This Regulation comprises matter that is of a transitional nature.

4     Construction of references to Tow Truck Industry Council

In the Tow Truck Act 1989, or in any other Act (except the Tow Truck Industry Act 1998) or in any other instrument, a reference to the Tow Truck Industry Council (as constituted by the Tow Truck Act 1989) is to be construed as a reference to the Tow Truck Authority (as constituted by the Tow Truck Industry Act 1998).
