Tourist and Heritage Railways Amendment Regulations 2019

The Governor in Council makes the following Regulations:

1Objective

The objective of these Regulations is to amend the Tourist and Heritage Railways Regulations 2011 to replace references to the Public Transport Development Authority with references to VicTrack as a consequence of the enactment of the Transport Legislation Amendment Act 2019.

2Authorising provision

These Regulations are made under section 31 of the Tourist and Heritage Railways Act 2010.

3Commencement

These Regulations come into operation on 1 January 2020.

4Composition of committee

In regulation 5(1)(b) and (2) of the Tourist and Heritage Railways Regulations 2011[1], for "the Public Transport Development Authority" substitute "VicTrack".

5Nomination of representatives of tourist and heritage railway operators

In regulation 6 of the Tourist and Heritage Railways Regulations 2011—

(a)in subregulations (1) and (4), for "The Public Transport Development Authority" substitute "VicTrack";

(b)in subregulation (3), for "the Public Transport Development Authority" substitute "VicTrack";

(c)in subregulation (5)—

(i)for "The Public Transport Development Authority" substitute "VicTrack";

(ii)for "the Public Transport Development Authority" substitute "VicTrack".

6Appointment of members

In regulation 7(1) and (2) of the Tourist and Heritage Railways Regulations 2011, for "The Public Transport Development Authority" substitute "VicTrack".

7Criteria for inclusion

In regulation 9(3) of the Tourist and Heritage Railways Regulations 2011, for "The Public Transport Development Authority" substitute "VicTrack".
