An Act to amend the Totalizator (Of-course Betting) Act 1964 relating to customer services, betting accounts, minimum bets and punters’ clubs. [Assented to 27 September 1996]

Section 1 Totalizator (Off-course Betting) Amendment Act 1996 No 72

The Legislature of New South Wales enacts:

1 Name of Act

This Act is the Totalizator (Off-course Betting) Amendment Act

1996.

2 Commencement

This Act commences on a day or days to be appointed by proclamation.

3 Amendment of Totalizator (Off-course Betting) Act 1964 No 1

The Totalizator (Off-course Betting) Act 1964 is amended as set out in Schedule l .

(Section 3)

[ 1 ]       Section 17 Provisions relating to the betting operations of the Board

Omit “(1A), (1AA) and (1AB)” from section 17 (l).
Insert instead “(1A)–(1C)”.

[2]       Section 17 (1C)

Insert after section 17 (1B):

(1C) Subsection (1) (a) does not prevent the Board providing, or approving of the provision of, ancillary customer services on a commercial basis at an office, branch or agency of the Board (including, for example, refreshment vending machines, pay telephones and the sale of race books or other products associated with racing).

Insert after section 17 (2) (a) (i):

(ia) at an office, branch or agency of the Board by charging the bet against a credit account referred to in paragraph (b) (i) established by the person making the bet, but only if the account is at that time sufficient to pay the amount of the bet,

Insert “(or a greater amount determined by the Minister)” after
“$1”.

Insert after section 14C:

17D Punters’ clubs

(1) The Board may conduct totalizator betting by means of punters’ clubs for the time being approved by the Board.
(2) A punters’ club is an arrangement under which participants invest in a pool held by the Board, the money in the pool is invested on bets chosen by a nominated person and any winnings are divided among the participants according to the amount each participant has invested in the pool.
(3) Bets placed by the nominated person may be notified by radio broadcast or in any other manner approved by the Board.
(4) The Board may make rules for the operation of punters’
clubs.

Omit “so made” from section 21 (1) (c).
Insert instead “made with the Board”.
