Act No. 91 ,1975 .

An Act to amend the Totalizator (Off-course Betting) Act, 1964, to make further provisions relating to the applica­ tion of moneys paid by the Totalizator Agency Board to a racing club, to remove restrictions relating to the provision of certain facilities in Totalizator Agency Board offices, branches and agencies, and for certain other purposes. [Assented to, 10th December, 1975.1

"BE it enacted by the Queen's Most Excellent Majesty, by
and with the advice and consent of the Legislative
Council and Legislative Assembly of New South Wales in

Parliament assembled, and by the authority of the same, as

follows:—

  1. This Act may be cited as the "Totalizator (Off-course

Betting) Amendment Act, 1975".

2. The Totalizator (Off-course Betting) Act, 1964, is

amended—

(a)

by omitting from section 3 (2) (f) the words "Kembla Grange Race Club" and by inserting instead the words "Wollongong Racing and Trotting Club";

(b)

by omitting from section 13 (2) the words "twenty- one years" and by inserting instead the words "eighteen years";

(c)

by omitting section 15 and by inserting instead the following section :—

15. Moneys paid by the Board to any club
pursuant to section 14 (3) (c) shall be applied by
that club for or towards—

(a)

the provision of facilities and amenities in connection with the club's premises, includ­ ing the installation and operation of totalizators therein;

(b)

the maintenance and improvement of those facilities and amenities;

(c)

the provision of prize money for any event or contingency held on the club's premises; and

(d)

(d)

the administration costs incurred by the club, either in connection with its own racing activities or in connection with racing generally.

(d) (i) by omitting section 17 (1) ( b ) ; (ii) by omitting section 17 (1) (d) .

3. Any nomination, selection or appointment purported to have been made under section 3 of the Totalizator (Off- course Betting) Act, 1964, at any time before the commence­ ment of this Act, being a nomination, a selection or an appointment that could have been made had the amendment made by section 2 (a) been in force at that time, is validated.
