Short title

1 . This Act may be cited as the ‘'Totalizator (Amendment) Act, 1920,” and shall be read witli tlie Totalizator Act, 1916 (hereinafter called the Principal Act) as amended bv the Totalizator (Amendment) Act,

2 . The Principal Act is amended as follows :—•

(1) Section two: Omit the words “ Colonial Secretary ” as inserted by subsection one of section two of the Totalizator (Amendment) Act, 1911), and insert in lieu thereof the words “ Colonial Treasureia”

(a)

In subsection one omit the words “ten pery.̂̂ j, centum” and insert in lieu tliereof the M'ords “ twelve and one-lialf per centum.”

(b)

Omit subsection two, as inserted by subsec­ tion four ol' section two of the 'totalizator (Amendment) Act, 11)19, and insert in lieu tliereof the following new subsection :—

(2) Every such club sliall within fourteen days after the holding of any race meeting, if a club specified in Part 1 of the Schedule hereto, pay nine per centum, and if a club s])(‘cified in Part I I of such Schedule five and one-ball ])er centum of the amount so ]):iid into the totalizator to tin' Colonial 'freasurer, or some person appointi'd by him, to be paid by him into the 'Preasury and carried to the Consolidatcal llevcniie Fund. Any such amount may lie recoveri'd from such club as a Crown debt in any court of comi^etcnt jurisdiction.

Omit subsection throe as amended by para­ graph (c) of subsection lour of section two of the 'fotalizator (Aniendincnt) Act, 1919, and tlie jiroviso to such subsection as amended by jiaragraph (d) of sulisection four of section two of the same Act.

In subsection one omit the second jiroviso as amended by paragrajih (a) of subsection live of section two of the 'fotalizator (Amendment) Act, 1919, and the third ])i'oviso as inserted by paragra})b (b) of the same subsection.

(b)

After subsection one insert the following new subsection :—-

(1a ) All unpaid fractions of a shilling and all dividends declared payable in respect of any race and unclaimed for a period of one month shall bo the property of such club.

Provided that if in the opinion of the Auditor-General such error was occasioned by the negligence of an agent or servant of the club (and the onus of proving to the satisfaction of the Auditor-General that it was not so occasioned shall lie upon the club), any loss caused or contributed to by such error shall he borne by the club.

(3) At the end of the first six months after the passing of the Totalizator (Amend­ ment) Act, 1920, and at the end of each succeeding six months thereafter the balance (if any) to the credit of such fund shall ho paid into the Consolidated Itevenue Eund.

(C) Section ten ;—

section two of the Totalizator (Amendment)

Act, 1919, is amended by inserting after the

word “ misused ” the Avords “ or he may recover a penalty not exceeding fifty 2)ounds in respect of each day of a race meeting at AA'hich the totalizator is mismanaged or mis­ used and which penalty is hereby prescribed.”

Tn subsection two omit the Avords “ ten jier

Sec. 17.
