Short title.

1 , This Act

may he cited a s the “ Totalizator

(Amendment) Act, 1919,” and shall bo read with the Totalizator Act, 1916, hereinafter called the Principal Act.

2 . The Principal Act is amended as follows:—

(1) Section two :—

Sec. 2.

The following definition is inserted next after

the definition of “ Inspector ” :—

“ Minister ” means Colonial Secretary.

The definition of “ Racing Cluh ” is amended by the addition of tlie words “ and includes the trustees of any ground on wliich such racing is licld.”

Sec. 3.

(2) Section tlirce :—■

In tlic first paragrapli after “ race meet­ ings” insert “ or on any onclosure in any such racecourse.”

(3) Section four :—

Omit the section, insert in lieu thereof :

4. Before any totalizator is established, Approval,

the totalizator and the proposed site thereof

shall be approved by the Minister.

Such approval may be subject to such conditions as the Minister may think fit.

(4) Section eight

î ec. s.

(a)

In subsection two omit the first paragraph and insert the following in lieu thereof :—

“ Every such club shall, wfithin fourteen days after the holding of any race-meeting, if a club specifiedin Part I of the Schedule hereto, pay seven-tenths, and if a club specified in Part I I of such Schedule, five-tenths of the amount so deducted to the Colonial Treasurer, or some person appointed by him, to be paid by him into the Treasury and carried to the Consolidated Revenue Fund. Any such amount may be recovered from such clul) as a Crown debt in any court of competent jurisdiction.”

(b)

Omit the second paragraph of tlie same subsection.

(c)

In subsection three after the words “ by the club” insert the words “ including interest thereon respectively at a I’ate to be approved by the Minister.”

(d)

In the proviso to subsection three after the word “ construction” insert the words “ and interest.”

(5) Section nine : Subsection one is amended by— seo. 9.

(a)

omitting the word “unclaimed” in the second proviso and by inserting in lieu thereof the word “ unpaid ” ; and

(b) by adding the following further proviso :—

“ Provided further that no dividend shall

be recoverable or paid except on presenta­

tion of the ticket for which the dividend

is claimed, or on proof to the satisfaction

of the Treasurer in manner to be prescribed

of the ownership and loss of such ticket.”

(8) Section seventeen: Omit “ notified by such club,” insert in lieu thereof “ prescribed liy the rules of such club which in no case shall be later than the time of the actual start o£ the race.”

(9) Section twenty : The following subsection is

added to the section :—

(2) Subject to the provisions of this Act> and subject to the approval of the Governor, a racing club may make rules relating to the apportionment and payment out of dividends, and generally regulating the management of any totalizator under its control.
