His Excellency the Governor, with the advice of the Executive Council, has made the following Regulation under the Totalizator Act 1997.

Under clause 11 (5) of Schedule 2 to the Totalizator Act 1997, the Minister may authorise payments out of the Racecourse Development Fund for specified purposes relating to the racing industry (eg to provide finance for improving the facilities of racing clubs). The object of this Regulation is to enable payments to be made out of that Fund into any fund that operates for the purposes of applying those payments for any one or more of the specified racing industry purposes.
This Regulation is made under the Totalizator Act 1997. including section
117 (the general regulation-making power) and clause 11 (5) (f) of Schedule
2 to the Act.

Totalizator Amendment (Racecourse Development Fund) Regulation 1998

1 Name of Regulation

This Regulation is the Totalizator Amendment (Racecourse

Development Fund) Regulation 1998.

2 Amendment of Totalizator Regulation 1998

The Totalizator Regulation 1998 is amended as set out in

Schedule 1.

Insert after clause 4:

5 Authorised payments out of Racecourse Development

Fund

In accordance with clause 11 (5) (f) of Schedule 2 to the Act, payments may be made out of the Racecourse Development Fund into any fund that the Minister is satisfied is a fund that operates for the purposes of applying those payments for any one or more of the purposes referred to in clause 11 (5) (a)–(e) of that Schedule.
