TOTALIZATOR ACT 1916—ORDER

I, the Honourable Gordon Samuels AC, Governor of the State of New South Wales, with the advice of the Executive Council, and on the recommendation of the Treasurer, and in pursuance of section 8A of the Totalizator Act 1916 make the Order set forth in the Schedule.

1. This Order is the Totalizator (Distribution of Commission-

Racecourse Totalizators) Order 1996.

2. This Order commences on 1st November 1996.

Definition

3. In this Order:

“the Act” means the Totalizator Act 1916.

Manner of distribution under section 8

5. The manner in which a racing club that uses a totalizator under the Act must distribute the relevant percentage of the balance referred to in section 8 (1) (b) (i) of the Act is as required by clauses 6–8.

Distribution of commission from bets with agency of TAB

6. In the case of money derived from bets made through the agency of the Totalizator Agency Board, the racing club:

(a)	must pay as commission to the Minister, to be credited to the Consolidated Fund, the proportion specified in item 1 of the Table to this clause for each type of totalizator specified in respect of that item, and
(b)	must pay as commission to the Minister in respect of a doubles or multiple selection totalizator, to be separately credited to the Consolidated Fund for the purposes of section 8B of the Act, the proportion specified in item 2 of that Table for the totalizator concerned, and
(c)	must pay as commission to the Minister in respect of a superfecta totalizator, to be separately credited to the Consolidated Fund for the purposes of section 8C of the Act, the proportion specified in item 3 of that Table for that totalizator, and
(d)	must pay as commission to the Totalizator Agency Board the proportion specified in item 4 of that Table for each type of totalizator specified in respect of that item.

Distribution of commission from bets made under section 3B with another racing club

7. In the case of money derived from bets made under section 3B of the Act with another racing club, the racing club:

(a)	must pay as commission to the other racing club, to be paid to the Minister to be credited to the Consolidated Fund, the proportion specified in item 1 of the Table to this clause for each type of totalizator specified in respect of that item, and
(b)	must pay as commission to the other racing club in respect of a doubles or multiple selection totalizator, to be paid to the Minister to be separately credited to the Consolidated Fund for the purposes of section 8B of the Act, the proportion specified in item 2 of that Table for the totalizator concerned, and
(c)	must pay as commission to the other racing club in respect of a superfecta totalizator, to be paid to the Minister to be separately credited to the Consolidated Fund for the purposes of section 8C of the Act, the proportion specified in item 3 of that Table for that totalizator, and
(d)	must pay as commission to the other racing club the proportion specified in item 4 of that Table for each type of totalizator specified in respect of that item.

8. In the case of money derived from bets made with the racing club

operating the totalizator, the racing club:

(a)	must pay as com+mission to the Minister, to be credited to the Consolidated Fund, the proportion specified in item 1 of the Table to this clause for each type of totalizator specified in respect of that item, and
(b)	must pay as commission to the Minister in respect of a doubles or multiple selection totalizator, to be separately credited to the Consolidated Fund for the purposes of section 8B of the Act, the proportion specified in item 2 of that Table for the totalizator concerned, and
(c)	must pay as commission to the Minister in respect of a superfecta totalizator, to be separately credited to the Consolidated Fund for the purposes of section 8C of the Act, the proportion specified in item 3 of that Table for that totalizator, and
(d)	may retain as commission the proportion specified in item 4 of that Table for each type of totalizator specified in respect of that item.

EXPLANATORY NOTE

The object of this Order is to specify the manner in which commission payable in respect of on-course totalizator betting is to be distributed.

This Order is made under section SA of the Totalizator Act 1916.
