Queensland Totalisator on Licensed Premises Act 1991 Act No. 66 of 1991 An Act to amend the Liquor Act 1912, the Racing and Betting Act 1980 and the Vagrants, Gaming, and Other Offences Act 1931 [Assented to 17 October 1991]

2 Totalisator on Licensed Premises No. 66, 1991 BE IT ENACTED by the Queen’s Most Excellent Majesty, by and with the advice and consent of the Legislative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows. PART 1—PRELIMINARY Short title 1. This Act may be cited as the Totalisator on Licensed Premises Act 1991 . PART 2—AMENDMENT OF LIQUOR ACT 1912 Amended Act 2. The Liquor Act 1912 is amended as set out in this Part. Amendment of s.51A (Machines, etc., capable of use for gaming, etc., not to be brought or kept on licensed premises) 3. At the end of section 51A— insert — ‘(5) Subsection (1) does not apply to the operation of a totalisator (including the installation and operation of machines and equipment) on premises that are licensed premises by or on behalf of The Totalisator Administration Board under the Racing and Betting Act 1980 . ’.

3 Totalisator on Licensed Premises No. 66, 1991 PART 3—AMENDMENT OF RACING AND BETTING ACT 1980 Amended Act 4. The Racing and Betting Act 1980 is amended as set out in this Part. Amendment of s.189 (Functions, powers and duties of Totalisator Board) 5. After section 189(3)— insert — ‘(3A) Before taking action under subsection (3)(a), (b) or (c) in relation to premises that are licensed premises under the LiquorAct1912 , the Totalisator Board is to consult with the Licensing Commission. ’. Amendment of s.221 (Betting on licensed premises) 6. At the end of section 221— insert — ‘(8) Subsection (1) does not apply to betting on a totalisator operated at a place by or on behalf of the Totalisator Board. ’. PART 4—AMENDMENT OF VAGRANTS, GAMING, AND OTHER OFFENCES ACT 1931 Amended Act 7. The Vagrants, Gaming, and Other Offences Act 1931 is amended as set out in this Part.

4 Totalisator on Licensed Premises Insertion of new s.22A 8. After section 22— insert — No. 66, 1991 ‘Application of s.22 ‘22A. Section 22 does not apply to betting on a totalisator operated at licensed premises by or on behalf of The Totalisator Administration Board under the Racing and Betting Act 1980 . ’.
