AN ACT to amend the Totalisator Duty Act,

1905-1970.

[Assented to 16th November, 1972.]

BE it enacted by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Council and the Legislative Assembly of Western Australia, in this present Parliament assembled, and by the authority of the same, as follows:—

1. (1) This Act may be cited as the Totalisator Short title

This Act shall come into operation on a date

to be fixed by proclamation.

Section 2

Section 2 of the principal Act is amended by adding after the word "horse-racing" where it occurs in line three and again in line four of the inter- pretation "Racing Club", the words "or greyhound racing", in both cases.

4. Section 3 of the principal Act is amended

(a)

by substituting for the word "sixpence" in line one of subsection (2), the words "five cents"; and

(b)

by repealing and re-enacting subsection (3) as follows

(3) The term "net takings"

(a)

except as provided in paragraph (b) of this subsection—means the gross takings of a totalisator less the totalisator commission which shall not exceed fifteen per centum of the gross takings;

(b)

where the totalisator is con- ducted on the system whereby all winning bets for a win or a place are deducted before the totalisator commission is deduct- ed—means the gross takings of the totalisator less the totalisator commission which shall not ex- ceed

(i)   twenty per centum of los- ing bets in the case of a totalisator pool conducted for a win; or

(ii)   twenty-five per centum of losing bets in the case of a totalisator pool conducted for a place.

Subsection (1) of section 4 of the principal Act is amended by substituting for the word "six- pence" in line five of paragraph (b), the words "five cents".

Subsection (1) of section 7 of the principal Act is amended by substituting for the word "six- pence" in line five of paragraph (c), the words "five cents".
