1. The applicant seeks special leave to appeal a unanimous decision of the Court of Appeal of the Supreme Court of Western Australia (Quinlan CJ, Beech and Vaughan JJA), which allowed an appeal from the Supreme Court of Western Australia (Master Sanderson).

2. The application does not raise any question of principle and there is otherwise no reason to doubt the correctness of the decision of the Court of Appeal.  Special leave should be refused.

3. Pursuant to r 41.08.1 of the High Court Rules 2004 (Cth), we direct the Registrar to draw up, sign and seal an order dismissing the application with costs.
