HIS HONOUR:   Is Mr Torney in Court?  Would you be good enough to call Mr Torney outside the Court, please.

MR D.A. PERKINS:   Can I indicate to your Honour that I do not appear in this matter.  I perhaps should indicate that my instructing solicitor spoke to Mr Torney at 8 o’clock this morning and he was then intending to be here by half past nine.  Save for telling your Honour that, I do not think I can assist your Honour.
