Patriotic Fund was raised in Toowoomba and its district by voluntary contributions in aid of the widows, orphans, and dependants of the A ustralian Contingent who had been or might be sent to ~ outh Africa, or for such other relief as might be necessary: And whereas at a meeting of the subscribers to the said :Fund held on the third day of January, one thousand nine hundred, it was resolved that the trustees of the said Funt! should consist of the Mayor of 'foowoomba, the Manager of the Australian Joint stock Bank, Limited, at Toowoomba, and the Polic~ Magistrate of Too'i\'oomba, such trusteeship to devolve upon whomsoever should be acting in either of the above positi')ns : And whereas the successor in interest of the aforesaid bank is the Australian Bank of Commerce, Limited, at Toowoomba: ,,7 And whereas the Boer ar, in respect of which the said Fund was established, came to an end on or about the thirty-first day of May, one thousand nine hundred and two; and, after making due provision for the purposes for which the said l?und was established, there remains in the hands of the said trustees the sum of one thousand seven hundred and twenty-fh'e pounds or thereabouts: And whereas at a meetir,g of a committee appointed by and representing the said subscribers held at '1'00- w08mba on the fourteenth day of August, one thousand

Boland, Esquire (Mayor of the City of Toowoomba), and W. H. Johnstone, Esquire PJ anager of the said Australian Bank of Commerce, Limited, 'l'oowoomba), as trustees of the said :Fund, should be and they 'were thereby authorised to take the necessary steps to have an Enabling Bill passed regarding the mid Fund on the same principles as that which was passed in Brisbane, and cited as " The Queensland Patriotic Fund Act of 1910,"* but with cer·· tain amendments in the said resolution mentioned and hereinafter incorporated: And whereas, notwithstanding that the said Fund has been justly and faithfully administered by the said trustees, doubts may arise as to their powers and jurisdiction in the premises, and it is expedient to set any such doubts at rest: And whereas the trustees of the said Fund are now the said Mayor, Bank Manager, and Police Magistrate, and it is expedient to continue the persons for the time being holding the said positions in their said offices as trustees, and to declare the powers of the said trustees and the trusts upon which the said Fund shall be held: Be it therefore enacted by the King's M ost Excellent Majesty, by and with the advice and consent of the Legislative Council and Legislati\'e Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows :- 1. This Act may be cited as" The ToowoolldHt Patl'iof1"c Short title. Fund Act of HH4." 2. The persons for the time being holding the positions Who shall be of Mayor of the City of Toowoomba, Police Magistrate trustees. at Toowoomba, and Manager of the Australian Hank of Commerce at Toowoomba, shall be trustees of the said Fund. If at any time any vacancy arises in the number of the said trustees by resignation addressed to the Home Secretary, or by failure to attend any of three consecutive meetings of the trustees convened during a period of six months, or by death, or other cause, it shall be lawful for the Governor in Council to appoint another trustee to fill the vacancy so arising. The said }-'und shall be invested by the trustees on deposit at the Government Savings Bank, at Toowoomba, to the credit of such account or accounts as the trustees think fit, and, notwithstanding any Act to the contrary, shall bear interest upJn the total amount thereof at the current prescribed rate of interest. Trusts on 4. The said Fund shall be held by the trustees upon' s w h h a i l c l h beFuhenldd. the trusts following, namely;- To apply the Fund and the income thereof, or so much thereof respectively as for the time being remains undisposed of (aftpr payment thereout of all proper expenses of and incidental to the administration thereof) for the relief, assistance, and benefit of such of the volun- teers from Queensland who have served in the British Forces in the prosecution of the said Boer War, or of the present War, or any future \Var in which any milit,ll'y or naval volunteer from To)woomba or its district is or shall be engaged, and of such of the relations and dependants of any such volunbers, and in such manner as the trustees shall, in their unfettered discretion, think fitting, so long as any such persons are, in the judgment of the trustees, entitled to any benefit, and also for any military or naval pUl'posewhich the trustees, with the previous consent of the Governor in Council, shall think proper.
