An Act to further amend the Law relating

Public Wharfs and the rates payable

thereat. [20^ ̂November, 1878.]

Preamtle.	\ \ I HEE/EAS it is expedient to amend the existing law relating to V y tonnage rates leviable at public wharfs Be it therefore enacted
by the Queen’s Most Exeellent Majesty by and ivith the advice and consent of the Legislative Council and Legislative Assembly of New South Wales in Parliament assembled and by the authority of the same as follows :—

Partial repeal of	1.	So much of the unrepealed portions of the Aet eighth Victoria
8 Vic. No. 16 and

10 Vic. No. 11.	number sixteen and of the Act tenth Victoria number eleven as exempts or may be construed to exempt all vessels loading unloading or refitting at any public wharf within the meaning of the said Acts from the payment of the tonnage rates thereby made payable for the respective periods specified in the Schedule to the said first-mentioned Act is hereby repealed.
Tonnage rates and	. 2. Prom and after tlie passing of this Aet it shall he lawful to levy a rate of one-half-penny per ton of register measurement per diem on all vessels loading unloading or refitting at any public wharf in the Colony hut such rate shall not he leviable in respect of vessels discharging the whole of their inward cargo at a public wharf until after the expu’ation of the periods specified in the Schedule hereto Provided always that in the case of any vessel which shall have discharged only a portion of her inward cargo at a public wharf such vessel shall be entitled to claim “ free lay days” according to the quantity of cargo discharged And the quantity of cargo so discharged shall he considered to he the registered tonnage of such vessel for the purpose of computing the lay days according to the scale in the said Schedule.

Saying clanse.	3. Nothing in this Act contained shall he construed so as to abridge or affect the right of any vessel now berthed at any public wharf in respect of the free lay days and other the provisions contained in the Acts hereby in part repealed.
Short title.	4. This Act may he cited for all purposes as the “ Tonnage Bates and Puhhc "Wharfs Amendment Act of 1878.”
