An Act to repeal the Rand wick and Coogee Road Trust Act, 1854, the Amended Rand- wick and Coogee Roads Trust Act of 1868, the Randwick and Coogee Roads Transfer Act of 1869, and the Randwick Toll-gate Removal Act; to declare the roads referred to in the said Acts to he public roads ; and to prevent the collection of Tolls thereon. the Randwick and Coogee Road, and Frenchman's Road, as set forth in Schedule A l thereto : And whereas by section four of the Amended Randwick and Coogee Roads Trust Act of 1868 the said Commissioners \vere empowered to appoint and direct tolls to be demanded, taken, and levied upon the said roads : And whereas by the last-mentioned Act and the Randwick and Coogee Roads Transfer Act of 1869 the said Commissioners were empowered to transfer a portion of the said roads to the Municipal Council of Sydney, and a portion thereof to the Municipal Council of Randwick : And whereas by the said Act it was provided that upon such transfer the said Councils should hold, occupy, possess, and enjoy in respect to the portions so transferred all the powers, privileges, rights, and authorities then vested in the said Com- missioners : And whereas the said portions have hecn so transferred : And

WH E R E A S by the Randwick and Coogee Road Trust Act, 1854, purpose oC making, managing, and upholding the old Botany Road, Commissioners were appointed with certain powers for the

And whereas in pursuance of powers conferred by the Randwick Toll- gate Removal Act the toll-gate then standing on the Eandwick Road was removed and a toll-bar established at the site of the junction of the Bunnarong or Defence Road with the Randwick Road : And whereas it is expedient that the said Acts should be repealed and that all tolls on the said roads should be abolished : Be it therefore enacted by the Queen's Most Excellent Majesty, by and with the advice and consent of tbe Legislative Council and Legislative Assembly of New South Wales in Parliament assembled, and by the authority of the same, as follows :—

1. The Eandwick and Coogee Eoad Trust Act, 1854, the Amended Eandwick and Coogee Roads Trust Act of 18(58, the Eandwick and Coogee Eoads Transfer Act of 1869, and the Eandwick Toll-gate Eemoval Act arc hereby repealed.

2. The roads set forth in Schedule A l to the Eandwick and Coogee Eoad Trust Act, 1851, so far as they arc; situated within the. boundaries of the Borough of Eandwick, are hereby declared to be 2>ublic roads within tbe meaning of the Municipalities Act of 1867, provided alwavs tliat notwithstanding anything contained in tbe Municipalities Act of 18(37 and any power thereby conferred, no tolls shall be demanded, taken, levied, or collected upon tbe roads set forth in the said Schedule, or at the site of the junction of the Bunnarong or Defence Eoad with the Eandwick Eoad.

3. This Act may be cited as " Tolls on Eandwick and Coogee Eoads Abolition Act."
