Application for approval of the Toll Customised Solutions (Australis Drive) Enterprise Agreement 2017.

[1] An application has been made for approval of an enterprise agreement known as the Toll Customised Solutions (Australis Drive) Enterprise Agreement 2017 (“the Agreement”). The application is made under s.185 of the Fair Work Act 2009 (Cth) (“the Act”) by Toll Transport Pty Ltd T/A Toll Customised Solutions (“Toll”). It is a single enterprise agreement.

[2] Toll has requested for commercial reasons that the wage rates and allowances to be paid under the terms and conditions contained in the Agreement remain confidential. Clause 20 of the Agreement confirms that this has been agreed to by the parties. Toll has provided the Commission with a Schedule of wage rates and allowances to apply under the terms of the Agreement. They indicate that the employees are clearly “better off overall” when those rates are compared with those contained in the underlying Storage Services and Wholesale Award 2010.

The Schedule includes a rate for a “Casual Team Member (base rate.)” It is also noted that sub clause 19.3.3 of the Agreement provides that an additional casual loading of 25% is to be paid in addition to this base rate set out in the Schedule.

[3] The Schedule will now be retained on the Commission’s file on a confidential basis.

[4] I am otherwise satisfied that each of the requirements of ss.186, 187 and 188 as are relevant to this application for approval have been met.

[5] The Agreement is approved and, in accordance with s.54 of the Act, will operate from 22 September 2017. The nominal expiry date of the Agreement is 30 June 2020.
