1Objective

The objective of these Regulations is to provide for the appointment of members of the Victorian Health Promotion Foundation.

2Authorising provision

These Regulations are made under section 43 of the Tobacco Act 1987.

3Commencement

These Regulations come into operation on 24 November 2020.

4Revocations

The Regulations set out in Schedule 1 are revoked.

5Appointment of members of Foundation

(1)Under section 21(3)(a) of the Tobacco Act 1987, the following persons are appointed as members of the Victorian Health Promotion Foundation—

(a)for the purposes of section 21(1)(a) of the Act—

(i)Professor Danielle Mazza AM; and

(ii)Ms Nicola Roxon; and

(iii)Mr Jeremy Laurence Millar, a person chosen by the Minister from a panel of three names submitted by the Anti-Cancer Council;

(b)for the purposes of section 21(1)(b) of the Act—

(i)Ms Stella Smith; and

(ii)Ms Rayoni Nelson, a person chosen by the Minister from a panel of three names submitted by the Sports Federation of Victoria; and

(iii)Ms Leigh Maxine Russell, a person nominated by the Minister as representing country sport;

(c)for the purposes of section 21(1)(c) of the Act—

(i)Ms Amanda Christine Kelly; and

(ii)Ms Divanisha Pillay;

(d)for the purposes of section 21(1)(d) of the Act, Ms Jamie Lewis;

(e)for the purposes of section 21(1)(e) of the Act, Mr Philip Wade.

(1A)Under section 21(3)(a) of the Tobacco Act 1987, Mr Ian Hamm is appointed as a member of the Victorian Health Promotion Foundation for the purposes of section 21(1)(b) of that Act for the period commencing 23 October 2024 and ending on 22 October 2027.

(2)The appointment referred to in subregulation (1)(a)(i) is for the period commencing on 5 March 2025 and ending on 4 March 2028.

(3)The appointment referred to in subregulation (1)(a)(ii) is for the period ending on 23 November 2025.

(4)The appointment referred to in subregulation (1)(a)(iii) is for the period commencing on 1 July 2025 and ending on 30 June 2028.

(5)The appointment referred to in subregulation (1)(b)(i) is for the period commencing on 4 September 2021 and ending on 3 September 2026.

(6)The appointment referred to in subregulation (1)(b)(ii) is for the period commencing on 1 July 2023 and ending on 30 June 2028.

(7)The appointment referred to in subregulation (1)(b)(iii) is for the period commencing on 1 July 2025 and ending on 30 June 2028.

(8)The appointment referred to in subregulation (1)(c)(i) is for the period commencing on 1 July 2025 and ending on 30 June 2028.

(9)The appointment referred to in subregulation (1)(c)(ii) is for the period commencing on 20 July 2021 and ending on 19 July 2026.

(9A)The appointment referred to in subregulation (1)(d) is for the period commencing on 1 July 2025 and ending on 30 June 2028.

(10)The appointment referred to in subregulation (1)(e) is for the period commencing on 5 October 2021 and ending on 4 October 2026.

The Tobacco (Victorian Health Promotion Foundation) Regulations 2020, S.R. No. 129/2020 were made on 17 November 2020 by the Governor in Council under section 43 of the Tobacco Act 1987, No. 81/1987 and came into operation on 24 November 2020: regulation 3.

The Tobacco (Victorian Health Promotion Foundation) Regulations 2020 will sunset 10 years after the day of making on 17 November 2030 (see section 5 of the Subordinate Legislation Act 1994).

INTERPRETATION OF LEGISLATION ACT 1984 (ILA)

Style changes

Section 54A of the ILA authorises the making of the style changes set out in Schedule 1 to that Act.

References to ILA s. 39B

Sidenotes which cite ILA s. 39B refer to section 39B of the ILA which provides that where an undivided regulation, rule or clause of a Schedule is amended by the insertion of one or more subregulations, subrules or subclauses the original regulation, rule or clause becomes subregulation, subrule or subclause (1) and is amended by the insertion of the expression "(1)" at the beginning of the original regulation, rule or clause.

Interpretation

As from 1 January 2001, amendments to section 36 of the ILA have the following effects:

•     Headings

All headings included in a Statutory Rule which is made on or after
1 January 2001 form part of that Statutory Rule.  Any heading inserted in a Statutory Rule which was made before 1 January 2001, by a Statutory Rule made on or after 1 January 2001, forms part of that Statutory Rule.
This includes headings to Parts, Divisions or Subdivisions in a Schedule; Orders; Parts into which an Order is divided; clauses; regulations; rules; items; tables; columns; examples; diagrams; notes or forms.

•     Examples, diagrams or notes

All examples, diagrams or notes included in a Statutory Rule which is made on or after 1 January 2001 form part of that Statutory Rule.  Any examples, diagrams or notes inserted in a Statutory Rule which was made before 1 January 2001, by a Statutory Rule made on or after 1 January 2001, form part of that Statutory Rule.  See section 36(3A).

•     Punctuation

All punctuation included in a Statutory Rule which is made on or after
1 January 2001 forms part of that Statutory Rule.  Any punctuation inserted in a Statutory Rule which was made before 1 January 2001, by a Statutory Rule made on or after 1 January 2001, forms part of that Statutory Rule.

•     Provision numbers

All provision numbers included in a Statutory Rule form part of that Statutory Rule, whether inserted in the Statutory Rule before, on or after
1 January 2001.  Provision numbers include regulation numbers, rule numbers, subregulation numbers, subrule numbers, paragraphs and subparagraphs.  See section 36(3C).

•     Location of "legislative items"

A "legislative item" is a penalty, an example or a note.  As from 13 October 2004, a legislative item relating to a provision of a Statutory Rule is taken to be at the foot of that provision even if it is preceded or followed by another legislative item that relates to that provision.  For example, if a penalty at the foot of a provision is followed by a note, both of these legislative items will be regarded as being at the foot of that provision.  See section 36B.

•     Other material

Any explanatory memorandum, table of provisions, endnotes, index and other material printed after the Endnotes does not form part of a Statutory Rule.  See section 36(3)(3D)(3E).
