Tobacco Products Regulation (Artistic Performances) Amendment Act 2016

An Act to amend the Tobacco Products Regulation Act 1997.

The Parliament of South Australia enacts as follows:

Part 1Preliminary1Short title

This Act may be cited as the Tobacco Products Regulation (Artistic Performances) Amendment Act 2016.

2Amendment provisions

In this Act, a provision under a heading referring to the amendment of a specified Act amends the Act so specified.

Part 2Amendment of Tobacco Products Regulation Act 19973Amendment of section 71 – Exemptions

Section 71—after subsection (4) insert:

  1. (5)

    Without limiting subsection (1), the Minister may, by notice in writing, exempt a person, or a class of persons, from the operation of a provision of this Act in respect of an artistic performance.

  2. (6)

    An exemption under subsection (5) may be conditional or unconditional.

  3. (7)

    The Minister may, by notice in writing, vary or revoke an exemption under subsection (5).
