1. These regulations may be cited as the Tobacco Products Control Regulations, 1987.

2. These regulations will come into operation on 1 July, 1987.

3. (1) In these regulations, unless the contrary intention appears—

"the Act" means the Tobacco Products Control Act, 1986.

(2) A transparent outer wrapping does not constitute a package for the purposes of these

regulations.

4. (1) The following health warnings are prescribed in relation to tobacco products that are

consumed by being smoked but not in relation to cigar or plug tobacco:

(2) A health warning displayed on a package must be set out as shown in subregulation (1).

(3) The first line must be printed in letters of at least 14pt using Univers 57 Medium

Condensed Roman type face in upper case.

(4) The second line must be printed in letters that are one half the point size of the letters of

the first line using Univers 55 Medium Roman type face in upper and lower case.

(5) The warning must be printed in one colour on a background of a contrasting colour.

(6) The background colour must extend above the warning over an area that is at least as

large as the area occupied by the first line of the warning.

(7) A picture, letter or other symbol must not occupy this area except that a trademark, or

part of a trademark, may occupy not more than one half of the area.

5. (1) A health warning must be displayed on the front and back of a packet of cigarettes.

(2) If a warning printed in accordance with regulation 4 would occupy more than 15 per cent of the face of a packet of cigarettes the letters may be reduced in size but not to the extent that the warning occupies less than 15 per cent of the area of the face of the packet.

(3) A health warning must be displayed on two faces of a carton or other package containing packets of cigarettes and if the faces are of different area the warning must be displayed on two of the largest faces of the package.

6. In the case of all other tobacco products, the warning must be displayed on every face of

the package on which the brand name of the product appears.

7. A health warning must be displayed at the bottom of the face of the package on which it

appears.

8. (1) The form, including the size, of the notice referred to in section 11(4) of the Act is set

out in the first schedule.

(2) The following parts of the notice must be printed in red:

(a)

the passages "18 years" and "proof of age";

(b)

thelinesundertheheadings"SALEOFTOBACCOPRODUCTS"and "PENALTIES";

(c)

the circle and diagonal of the no smoking symbol.

(3) Subregulation (2) does not limit the generality of subregulation (1).

9. (1) The form, including the size, of the notice referred to in section 13(2) of the Act is set

out in the second schedule.

(2) The notice must be made of metal or plastic.
