Tobacco (Amendment) Regulations 2003

The Governor in Council makes the following Regulations:

1. Objective

The objective of these Regulations is to amend the Tobacco Regulations 1997 to make the prescribed requirements for no smoking signs in enclosed

restaurants and cafes and in dining areas
consistent with provisions in the Tobacco Act
1987 requiring no smoking signs in other no

smoking areas.

2. Authorising provision

These Regulations are made under section 43 of the Tobacco Act 1987.

3. Commencement

These Regulations come into operation on 1 May
2003.

4. Regulation 4AA substituted

For regulation 4AA of the Tobacco Regulations

19971 substitute—

'4AA. Enclosed restaurants and cafes and dining

areas: no smoking signs

For the purposes of section 5BA(2) of the

Act—

(a) the prescribed requirements as to size and the information contained in the no smoking signs are that the signs—

(i)  contain a no smoking symbol in the form of a circle and diagonal line printed in red over a depiction

of a cigarette and smoke printed in black, or other symbol that clearly indicates that smoking is not

permitted, with the symbol being
at least 70mm in height; and
(ii)

or "Smoking Prohibited", or
other wording that clearly
indicates that smoking is not

contain the phrase "No Smoking" least 20mm in height; and

(b)

the prescribed manner for the display of the no smoking signs is that they are displayed in a manner that ensures that a person is reasonably likely to see one or more of them either on entering an enclosed restaurant or cafe or a dining area or from within the enclosed restaurant or cafe or from within the dining area.'.
