Tobacco (Amendment) Act 1993

An Act to amend the Tobacco Act 1927

The Legislative Assembly for the Australian Capital Territory enacts as follows:

Short title

1.  This Act may be cited as the Tobacco (Amendment) Act 1993.

Commencement

2.  This Act commences on the day on which it is notified in the Gazette.

Principal Act

3.  In this Act, “Principal Act” means the Tobacco Act 1927.1

Certain advertising prohibited

4.  Section 10 of the Principal Act is amended—

(a)by inserting in paragraph (2) (f) “, and according with the conditions (if any) specified in,” after “in”; and

(b)by inserting after subsection (3) the following subsection:

“(3A)  A notice under subsection (3) may include conditions to which the exemption is subject.”.

Removal of tobacco advertisements

5.  Section 11 of the Principal Act is amended—

(a)by omitting from subsection (1) “the period of 30 days” and substituting “a specified period (not exceeding 2 days)”;

(b)by omitting from paragraph (2) (b) “of 30 days after that notice is given” and substituting “specified in the notice”; and

(c)by omitting subsection (5) and substituting the following subsections:

“(5)  The Minister may, by instrument, appoint persons as authorised officers for the purposes of this section.

“(6)  In this section—

‘authorised officer’ means—

(a)a person appointed under subsection (5); or

(b)an inspector within the meaning of the Public Health Act 1928.”.

Prohibition of sponsorships

6.  Section 12 of the Principal Act is amended—

(a)by inserting in paragraph (3) (b) “, and according with the conditions (if any) specified in,” after “in”; and

(b)by inserting after subsection (4) the following subsection:

“(4A)  A notice under subsection (4) may include conditions to which the exemption is subject.”.
