An Act to amend the Tobacco Advertising Prohibition Act 1992

The Parliament of Australia enacts:

1Short title

This Act may be cited as the Tobacco Advertising Prohibition Amendment Act 2000.

2Commencement

This Act commences on the day on which it receives the Royal Assent.

3Schedule(s)

Each Act that is specified in a Schedule to this Act is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this Act has effect according to its terms.

Schedule 1Amendment of theTobacco Advertising Prohibition Act 1992

Subsection 18(2)

Repeal the subsection, substitute:

  1. (2)

    For the purposes of subsection (1), the Minister may, by notice published in the Gazette, specify a sporting or cultural event to be held in Australia if, and only if:

    1. (a)

      the Minister is satisfied that the event will be completed before 1 October 2006; and

    2. (b)

      in a case where the event is to be held on or after 1 October 2000:

      1. (i)

        a similar event held before that date (the earlier event) was specified in a notice under this subsection; and

      2. (ii)

        no application to have another similar event specified in a notice under this subsection has been rejected since the earlier event; and

    3. (c)

      the Minister is satisfied, having regard to the guidelines in force under subsection (5), that:

      1. (i)

        the event is of international significance; and

      2. (ii)

        failure to specify the event would be likely to result in the event not being held in Australia.

After section 34

Insert:

34A

Reports to Parliament

  1. (1)

    As soon as practicable after each 31 December occurring after 1 January 2001, the Minister must cause to be prepared a report on:

    1. (a)

      the number and nature of any contraventions of the Act occurring in the preceding 12 months; and

    2. (b)

      action taken by the Minister or a Commonwealth agency in response to each contravention.

  2. (2)

    A person who prepares a report under subsection (1) must give a copy to the Minister.

  3. (3)

    The Minister must cause copies of the report to be laid before each House of the Parliament within 15 sitting days of that House after receiving it.
