GORDON J:   In this matter, Chief Justice French, Justice Nettle and I are of the view that there should be a grant of special leave, subject to the applicant filing in Court within seven days a written undertaking that the applicant pay the respondent’s costs of the appeal in any event and will not seek to disturb the costs orders in the court below.  We order that the filing and service of the respondent’s summary of argument pursuant to rule 41.06 be dispensed with, that the hearing of the appeal be expedited and heard together with the hearing of matter M86 of 2016 and that all directions necessary for the undertaking of the appeal made in matter M86 of 2016 also be made in this matter.
