This regulation may be cited as the Timber Utilisation and Marketing Amendment Regulation (No. 1) 1994 . ˙ Regulation amended 2. This regulation amends the Timber Utilisation and Marketing Regulation 1987 . ˙ Omission of ss 3 and 4 3. Sections 3 and 4— omit. ˙ Amendment of s 5 (Interpretation) 4.(1) Section 5, heading— omit, insert— ‘ Definition ’. (2) Section 5, definition “Act” — omit. ˙ Replacement of s 6 (Forms) 5. Section 6— omit, insert— ˙ ‘ Forms ‘ 6. The chief executive may approve forms for use under the Act.’. ˙ Replacement of s 7 (Fees) 6. Section 7— omit, insert—

s 12 5 s 13 Timber Utilisation and Marketing Amendment No. 426, 1994 (No. 1) ˙ ‘ H levels for preservative treated timber ‘ 15.(1) The chief executive may assign to timber treated with an approved preservative treatment an H level stated in column 1 of Schedule 7. ‘ (2) The conditions in which it is appropriate to use the timber are the conditions stated in column 2 of Schedule 7 for the H level assigned to the timber and an H level of a lower number. Example of subsection (2)— Timber assigned an H4 level is appropriate for use in the conditions stated for H4, H3, H2 or H1 level timber.’. ˙ Omission of Sch 1 12. Schedule 1— omit. ˙ Replacement of Sch 8 (H levels and conditions of use) 13. Schedule 8— omit, insert— ‘ SCHEDULE 8 ‘ H LEVELS AND CONDITIONS OF USE section 15 Column 1 H level H1 Column 2 Conditions of use 1. Appropriate for use in a well ventilated place where the timber is kept off the ground and completely protected from weather and wetting.

Appropriate for use in a well ventilated place where the timber is kept off the ground and completely protected from weather and wetting. 2. The treatment is designed to reduce the likelihood of attack by insects including termites. H3 1. Appropriate for use in a place where the timber is kept off the ground but is exposed to weather or periodic wetting. 2. The treatment is designed to reduce the likelihood of attack by insects, including termites, and decay. H4 1. Appropriate for use in a place where the timber is in contact with the ground or is not in contact with the ground but is continually damp. 2. The treatment is designed to reduce the likelihood of attack by insects, including termites, and severe decay. H5 1. Appropriate for use in a place where the timber is in contact with the ground or fresh water. 2. The treatment is designed to reduce the likelihood of attack by insects, including termites, and very severe decay. H6 1. Appropriate for use in a place where the timber is in prolonged contact with sea water. 2. The treatment is designed to reduce the likelihood of attack by marine borer and very severe decay.’. ˙ Renumbering of Schs 2–8 14. Schedules 2 to 8— renumber as Schedules 1 to 7.
