384 Queenslan4 ANNO TERTIO DECIMO ELIZABETHAE SECUNDAE REGINAE No. 43 of 1964 An Act to Amend "The Timber Users' Protection Acts, 1949 to 1955," in certain particulars [ASSENTED TO 12Th NOVEMBER, 1964] BE IT ENACTED by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows:- 1. (1) Short title. This Act may be cited as " The Timber Users' Protection Acts Amendment Act of 1964." (2) Principal Act. " The Timber Users' Protection Acts, 1949 to 1955 " are in this Act referred to as the Principal Act. (3) Collective title. The Principal Act and this Act may be collectively cited as " The Timber Users' Protection Acts, 1949 to 1964." 2. Amendments of s. 3 . Section three of the Principal Act is amended by- (a) omitting the definition "Approved preservative treatment ", and inserting in its stead the following definition: " "Approved preservative treatment "-A preservative treatment which has been approved by the Conservator of Forests pursuant to this Act; "; (b) in the definition "Article ", omitting the words " Any article in the manufacture " and inserting in their stead the words "Anything, other than a building, in the manufacture or construction ";

Timber Users' Protection Acts Amendment Act of 1964, No. 43 385 (c) omitting the definition " Board "; (d) inserting after the definition " Building operation " the following definition:- ""Conservator of Forests "-The Conservator of Forests within the meaning of " The Forestry Acts, 1959 to 1964 "; "; (e) omitting the definition " Forest officer " and inserting in its stead the following definition:- " Foresstt officer "-A forest officer within the meaning of " The Forestry Acts, 1959 to 1964 " and any other person authorized in that behalf from time to time by the Conservator of Forests pursuant to this Act;"; (f) in the definition " Registered brand ", omitting the word " Board " and inserting in' its stead the words " Conservator of Forests "; (g) in the definition " Timber ", omitting the words " plywood and ". 3. Amendments of s. 4 . Section four of the Principal Act is amended by- (a) in subsection (2), omitting the word " Board " and inserting in its stead the words " Conservator of Forests "; (b) omitting subsection (3). 4. Amendment of s. 10 . Section ten of the Principal Act is amended by omitting the word " Board " where that word appears and inserting in its stead the words " Conservator of Forests ". 5. Amendment of s. 11 . Section eleven of the Principal Act is amended by omitting the word " Board " and inserting in its stead the words " Conservator of Forests". 6. Amendments of s. 14 . Section fourteen of the Principal Act is amended by- (a) in subsection (1), omitting the words " with the object of protecting from attack by lyctus "; (b) in subsection (2)- (i) omitting the word " Board " where that word appears and inserting in its stead the words " Conservator of Forests "; (ii) inserting after the word " brand " the words " or brands "; (c) in subsection (3)- (i) omitting the word " Board " and inserting in its stead the words " Conservator of Forests "; (ii) omitting the words " and for use in a preservative treatment plant " and inserting in their stead the words " each preservative treatment as used in a preservative treatment plant "; (d) in subsection (4), inserting after paragraph (a) the following proviso:- Provided that where pieces of veneer of any width or pieces of timber each of a width of not more than two inches are bound in bundles for sale by the bundle it shall be sufficient compliance with this paragraph if- (i) At least ten per centum of the pieces of veneer or timber, as the case may be, is branded; and 13

386 Timber Users' Protection Acts Amendment Act of 1964, No. 43 (ii) In at least two places on the outer wrapping of the bundle or on a label attached to the bundle or so as to be clearly visible to a purchaser of the bundle there is stamped the registered brand and there is indicated the number of pieces of veneer or timber, as the case may be, in the bundle."; (e) in subsection (5)- (i) omitting the word " Board " and inserting in its stead the words " Conservator of Forests "; (ii) omitting the words " with the object of protecting same against attack by lyctus "; (f) in subsection (6), omitting the word " Board " and inserting in its stead the words " Conservator of Forests ". 7. Amendment of s. 15 . Section fifteen of the Principal Act is amended by, in subsection (3), omitting the words " chairman or the secretary of the Board " where those words appear and inserting in their stead the words " Conservator of Forests or the secretary to the Conservator of Forests and the Department of Forestry ". 8. Amendment of s. 16 . Section sixteen is amended by, in subsection (3), omitting the word " Board " and inserting in its stead the words Conservator of Forests ". 9. Amendment of s. 18 . Section eighteen of the Principal Act is amended by omitting the word "Board" where that word appears and inserting in its stead the words " Conservator of Forests ".
