REGULATION.

No. 69 of 1969.

AN ACT to amend the Timber Industry Regulation

Act, 1926-1968.

[Assented to 27th October, 1969.]

RE it enacted by the Queen's Most Excellent

Majesty, by and with the advice and consent of the Legislative Council and the Legislative Assembly of Western Australia, in this present Parliament assembled, and by the authority of the same, as follows:—

1. (1) This Act may be cited as the Timber Short title

and citation.

Amendment

to s. 2.

2. Section 2 of the principal Act is amended

(a)

by adding after the section number "2." the subsection designation "(1)"; and

(b) by adding a subsection as follows

(2) Without limiting the application of the provisions of the Interpretation Act, 1918, a reference in this Act to the words "this Act" shall, except in section twelve A, subsection (4) of section twenty-one, paragraph (20) of section twenty-three, section twenty-six, section twenty-seven, section twenty-eight, and subsection (1) of section twenty-nine, be read as including regulations made under this Act. .

3. The principal Act is amended by repealing

of s. 10.

section 10 and re-enacting it as follows-

10. (1) An owner, agent, and a manager shall furnish to an inspector the means necessary for making an entry, inspection, examination, or inquiry under this Act.

(2)

A person shall obey the directions of an inspector given under this Act.

(3) A person shall not hinder an inspector acting in the exercise of his powers under this Act. .

Amendment

4. Section 18 of the principal Act is amended by

repealing subsection (1) and re-enacting it as

follows

(1) Where power driven machinery is used on a timber holding, sawmill, yard, bush landing, mill landing, or workshop the owner shall provide and keep ready for use such first aid materials as are prescribed. .

Amendment

to s. 23.

5. Section 23 of the principal Act is amended

as to paragraph (1) by adding after the word

"duties", in line three, the words "and authorising

them to give such directions as are necessary for

carrying this Act into effect".

6. The principal Act is amended by adding after it.'2111,thrs of

section 23 a section as follows-

23A. (1) Regulations may be made under

section twenty-three of this Act

(a) so as to apply

(i)    generally or in a particular class of case or in particular classes of cases;

(ii)    at all times or at a specified time or at specified times; and

(iii)    throughout the State or in a specified part or specified parts of the State;

(b)

so as to require a matter affected by them to be-

(i)   in accordance with a specified standard or specified require- ment; or

(ii)    as approved by, or to the satis- faction of, a specified person or body or a specified class of person or body;

(c)

so as to confer on a specified person or body or a specified class of person or body a discretionary authority;

(d)

so as to provide that, in specified cases or a specified class of case or specified classes of cases, whether on specified conditions or unconditionally, persons or things of a class or classes of persons or things may be exempted from the provisions of the regulations, either wholly or to such extent as is specified.

(2) In subsection (1) of this section

"specified" means specified in the regulations. .
