An Act to amend the Timber Industry (Interim Protection) Act 1992 to extend its provisions to control logging within the Eden Native Forest Management Area and to postpone the expiry date of that Act. [Assented to 16 May 1994]

The Legislature of New South Wales enacts:
Short title
1. This Act may be cited as the Timber Industry (Interim Protection)
Amendment Act 1994.
Commencement
2. This Act commences on the date of assent.

Mumbulla State Forest No. 605, compartment 2133must not be logged until after all the parts of the Eden Native Forest Management Area to which this Part applies and for which logging is authorised have been logged and unless any licence that is necessary before logging in those compartments can be carried out has been issued under the National Parks and Wildlife Act 1974 by the Director-General of National Parks and Wildlife. Such a licence may not be issued unless, because of wet weather or some other contingency, logging cannot be carried out in other areas.
Each quarterly report required under section 15 must include specific reference to the compartments listed above indicating whether logging is scheduled, is being carried out or has been completed.
PART 3—REGULATORY AND PUBLIC
INFORMATION COMMITTEE
1. There is established by this Part, for the areas specified
in Parts 1 and 2 of this Schedule, a committee comprising:

the Director-General of National Parks and Wildlife or
the Director-General’s nominee; and
the Director-General of the Environment Protection
Authority or the Director-General’s nominee; and
the Director of the Soil Conservation Service or the
Director’s nominee; anda nominee of the Forestry Commission.
The functions of the committee are:
to determine the compartments to be logged and the
sites of roads proposed by the Forestry Commission
during any period when logging and roading takes
place before the Forestry Commission obtains an
environmental impact statement for those
compartments or sites or before the Minister for
Planning makes a determination under Division 4 of
Part 5 of the EPA Act concerning logging operations
within those compartments; and
to monitor logging and roading undertaken by or on
behalf of the Forestry Commission after the Minister
for Planning makes a determination under Division 4
of Part 5 of the EPA Act concerning logging operations
within the Area; and
to keep a register containing particulars of:(i) proposed logging and roading plans; and
(ii) licences issued by the Director-General of,
National Parks and Wildlife and by the Environment Protection Authority; and (iii) timber licences issued by the Forestry Commission; and
(iv) any monitoring reports of the Forestry Commission, the National Parks and Wildlife Service, the Environment Protection Authority or the Soil Conservation Service.
3. The Forestry Commission must submit a proposed logging and roading plan to the committee not less than 40 days before it adopts the plan or not less than such shorter period as may be agreed to by the committee in the event of wet weather or some other contingency.

4. Anyone may inspect the committee’s register during ordinary office hours at the head office of the Forestry Commission, without cost.
5. Anyone may obtain a copy of the whole or part of the committee’s register for the reasonable cost of making the copy.
6. The first meeting of the committee is to be held within
40 days after the commencement of this Part.
