Threatened Species Protection Order (No. 2) 2011

I make the following order under section 13(5) of the Threatened Species Protection Act 1995 .14 September 2011

1Short titleThis order may be cited as the Threatened Species Protection Order (No. 2) 2011 . 2CommencementThis order takes effect on the day on which its making is notified in the Gazette. 3Principal ActIn this order, the Threatened Species Protection Act 1995 is referred to as the Principal Act. 4Schedule 3 amended (Taxa of native flora and fauna which are endangered) Schedule 3 to the Principal Act is amended as follows: (a) by omitting item 14 from the table headed "Birds" in Subdivision 1 of Division 1 of Part 1 ; (b) by inserting after item 15 in the table headed "Birds" in Subdivision 1 of Division 1 of Part 1 the following:

15A.  Sternula albifrons sinensis Gmelin Little Tern

(c) by omitting item 6 from the table headed "Fish" in Subdivision 1 of Division 1 of Part 1 and substituting the following:

6.  Zearaja maugeana Last & Gledhill Port Davey Skate

(d) by omitting item 21A from Subdivision 2 of Division 1 of Part 1 ; (e) by omitting item 28 from Subdivision 1 of Division 2 of Part 1 and substituting the following:

28.  Hydrocotyle laxiflora DC., Apiaceae stinking pennywort

(f) by inserting after item 43 in Subdivision 1 of Division 2 of Part 1 the following:

43A.  Senecio psilocarpus Belcher & Albr., Asteraceae swamp fireweed

(g) by omitting item 28 from Subdivision 2 of Division 2 of Part 1 ; (h) by inserting after item 40 in Subdivision 2 of Division 2 of Part 1 the following:

40A.  Prasophyllum sp. Arthurs Lake (R.Smith DLJ11363) Tas Herbarium, Orchidaceae mountain leek-orchid

(i) by omitting item 56B from Subdivision 2 of Division 2 of Part 1 and substituting the following:

56B.  Wurmbea latifolia subsp. vanessae R.J.Bates, Liliaceae broadleaf early nancy

(j) by inserting after item 2 in Subdivision 2 of Division 1 of Part 2 the following:

3.  Hypolimnus pedderensis (Jamieson), Haplotaxida Lake Pedder Earthworm

(k) by inserting after item 12 in Subdivision 1 of Division 2 of Part 2 the following:

12A.  Senecio georgianus DC., Asteraceae grey groundsel

5Schedule 4 amended (Taxa of native flora and fauna which are vulnerable) Schedule 4 to the Principal Act is amended as follows: (a) by omitting item 9 from Subdivision 2 of Division 1 of Part 1 ; (b) by inserting after item 10 in Subdivision 2 of Division 1 of Part 1 the following:

10A.  Sternula nereis nereis Gould Fairy Tern

(c) by omitting item 8 from Division 1 of Part 2 ; (d) by omitting item 22 from Division 1 of Part 2 and substituting the following:

22.  Isoetopsis graminifolia Turcz., Asteraceae grass cushion

(e) by omitting item 30 from Division 1 of Part 2 ; (f) by inserting after item 35 in Division 1 of Part 2 the following:

35A.  Poranthera petalifera (Orchard & J.B.Davies) Halford & R.J.F.Hend., Euphorbiaceae mountain poranthera

(g) by inserting after item 40 in Division 1 of Part 2 the following:

40A.  Scaevola albida (Sm.) Druce, Goodeniaceae pale fanflower

(h) by inserting after item 48 in Division 1 of Part 2 the following:

48A.  Veronica ciliolata subsp. fiordensis (Ashwin) Meudt, Scrophulariaceae ben lomond cushionplant

6Schedule 5 amended (Taxa of native flora and fauna which are rare) Part 2 of Schedule 5 to the Principal Act is amended as follows: (a) by omitting item 18 from Division 1 ; (b) by omitting item 21 from Division 1 ; (c) by inserting after item 84 in Division 1 the following:

84A.  Liparophyllum exaltatum (Sol. ex Sims) Tippery & Les, Menyanthaceae erect marshflower

(d) by omitting item 123 from Division 1 ; (e) by omitting item 145 from Division 1 ; (f) by omitting item 34 from Division 2 .

EXPLANATORY NOTE

(This note is not part of the order) This order amends the

(a) adding certain species to, and omitting certain species from, the Schedules of endangered, vulnerable and rare flora and fauna; and (b) updating certain taxonomic, authority and common name references in those Schedules.
