Threatened Species Protection Order (No. 2) 2008

I make the following order under section 13(5) of the Threatened Species Protection Act 1995 .26 September 2008

1Short titleThis order may be cited as the Threatened Species Protection Order (No. 2) 2008 . 2CommencementThis order takes effect on the day on which its making is notified in the Gazette. 3Principal ActIn this order, the Threatened Species Protection Act 1995 is referred to as the Principal Act. 4Schedule 3 amended (Taxa of native flora and fauna which are endangered) Subdivision 2 of Division 2 of Part 1 of Schedule 3 to the Principal Act is amended as follows: (a) by inserting after item 28 the following:

28A.  Prasophyllum aff. pyriforme (J.Whinray HO524739), Orchidaceae graceful leek-orchid

(b) by inserting after item 30 the following:

30A.  Prasophyllum atratum D.L.Jones, Orchidaceae three hummock leek-orchid

(c) by inserting after item 31 the following:

31A.  Prasophyllum crebriflorum D.L.Jones, Orchidaceae crowded leek-orchid

(d) by inserting after item 33 the following:

33A.  Prasophyllum limnetes D.L.Jones, Orchidaceae marsh leek-orchid

(e) by omitting item 38 ; (f) by inserting after item 56 the following:

56A.  Triglochin mucronatum R.Br., Juncaginaceae prickly arrowgrass

5Schedule 4 amended (Taxa of native flora and fauna which are vulnerable) Division 2 of Part 1 of Schedule 4 to the Principal Act is amended as follows: (a) by inserting after item 3 the following:

3A.  Beddomeia briansmithi Ponder & Clark, Mesogastropoda Hydrobiid Snail (Fern Creek)

(b) by inserting after item 5 the following:

5A.  Beddomeia phasianella Ponder & Clark, Mesogastropoda Hydrobiid Snail (Keddies Creek)

(c) by inserting after item 19 the following:

19A.  Parvulastra vivipara (Dartnall), Asterinidae Live-bearing Seastar

(d) by omitting item 21 . 6Schedule 5 amended (Taxa of native flora and fauna which are rare) Schedule 5 to the Principal Act is amended as follows: (a) by omitting item 5 from Division 2 of Part 1 ; (b) by omitting item 14 from Division 2 of Part 1 ; (c) by inserting after item 39 in Division 1 of Part 2 the following:

39A.  Cyathodes platystoma C.M.Weiller, Epacridaceae tall cheeseberry

(d) by omitting item 1 from Division 4 of Part 2 and substituting the following:

1.  Ambuchanania leucobryoides (Yamaguchi, Seppelt, Iwatsuki & Buchanan) Seppelt & Crum, Ambuchananiaceae daisy pan moss

Displayed and numbered in accordance with the Rules Publication Act 1953.

EXPLANATORY NOTE

(This note is not part of the order) This order amends the

(a) adding certain species to, and omitting certain species from, the Schedules of endangered, vulnerable and rare flora and fauna; and (b) updating a common name reference in the Schedule of rare flora and fauna.
