Threatened Species Protection Order 2009

I make the following order under section 13(5) of the Threatened Species Protection Act 1995 .24 February 2009

1Short titleThis order may be cited as the Threatened Species Protection Order 2009 . 2CommencementThis order takes effect on the day on which its making is notified in the Gazette. 3Principal ActIn this order, the Threatened Species Protection Act 1995 is referred to as the Principal Act. 4Schedule 3 amended (Taxa of native flora and fauna which are endangered) Schedule 3 to the Principal Act is amended as follows: (a) by inserting after item 11 in Subdivision 1 of Division 2 of Part 1 the following:

11A.  Epacris exserta R.Br., Epacridaceae south esk heath

(b) by inserting after item 34 in Subdivision 1 of Division 2 of Part 1 the following:

34A.  Myosurus australis F.Muell., Ranunculaceae southern mousetail

(c) by omitting item 2 from Subdivision 2 of Division 2 of Part 1 ; (d) by inserting after item 23 in Subdivision 2 of Division 2 of Part 1 the following:

23A.  Corunastylis nudiscapa (Hook.f.) D.L.Jones & M.A.Clem., Orchidaceae bare midge-orchid

(e) by inserting after item 51 in Subdivision 2 of Division 2 of Part 1 the following:

51A.  Thelymitra atronitida Jeanes, Orchidaceae blackhood sun-orchid

(f) by omitting item 8 from Subdivision 1 of Division 2 of Part 2 ; (g) by omitting item 2 from Subdivision 2 of Division 2 of Part 2 . 5Schedule 4 amended (Taxa of native flora and fauna which are vulnerable) Division 1 of Part 2 of Schedule 4 to the Principal Act is amended as follows: (a) by omitting item 11 ; (b) by inserting after item 44 the following:

44A.  Stackhousia pulvinaris F.Muell., Stackhousiaceae alpine candles

6Schedule 5 amended (Taxa of native flora and fauna which are rare) Division 1 of Part 2 of Schedule 5 to the Principal Act is amended as follows: (a) by inserting after item 45 the following:

45A.  Epacris moscaliana Crowden, Epacridaceae seepage heath

(b) by omitting item 133 .

EXPLANATORY NOTE

(This note is not part of the order) This order amends the

(a) adding certain species to, and omitting certain species from, the Schedules of endangered, vulnerable and rare flora and fauna; and (b) updating a common name reference in the Schedule of endangered flora and fauna.
