Threatened Species Protection Amendment Act 2018

An Act to amend the Threatened Species Protection Act 1995

[Royal Assent 10 September 2018]

Be it enacted by Her Excellency the Governor of Tasmania, by and with the advice and consent of the Legislative Council and House of Assembly, in Parliament assembled, as follows:

1Short titleThis Act may be cited as the Threatened Species Protection Amendment Act 2018 . 2CommencementThis Act commences on the day on which this Act receives the Royal Assent. 3Principal ActIn this Act, the Threatened Species Protection Act 1995 is referred to as the Principal Act. 4Section 51 amended (Offences relating to listed taxa) Section 51(1) of the Principal Act is amended by omitting the penalty and substituting the following penalty:

Penalty:  Fine not exceeding 629 penalty units or imprisonment for a term not exceeding 12 months, or both, and a further fine not exceeding 126 penalty units for each day during which the offence continues after conviction.

5Section 61 amended (Regulations) Section 61(3) of the Principal Act is amended by omitting paragraph (b) and substituting the following paragraph: (b) in respect of such an offence, provide for the imposition of either or both of the following: (i) imprisonment for a term not exceeding 12 months; (ii) a fine not exceeding 629 penalty units and, in the case of a continuing offence, a further fine not exceeding 126 penalty units for each day during which the offence continues after conviction. 6Repeal of ActThis Act is repealed on the three hundred and sixty fifth day from the day on which it commences.
