Notice of Final Determination and Amendment of Schedule 1 to Act

The Scientific Committee established under the Threatened Species Conservation Act 1995 has, in pursuance of Division 3 of Part 2 of that Act, made a final determination to amend Part 2 of Schedule 1 to that Act (Endangered populations) as follows and, accordingly, that Schedule is amended as set out in Annexure “A” to this Notice:

(a) to insert the following population of bird:

Birds

Spheniscidae

Eudyptula minor (Forster, 1781) Little Penguin in the Manly Point Area (being the area on and near the shoreline from Cannae Po in t genera l ly northward to the point near the intersection of Stuart Street and Oyama Cove Avenue, and extending 100 metres offshore from that shoreline)
(b)	to omit reference to the following population of bird:

Birds

Spheniscidae

Eudyptula minor (Forster, 1781) Little Penguin at Manly Point

The final determination to insert this population in Part 2 of Schedule 1 has been made because the Scientific Committee is of the opinion that its numbers have been reduced to such a critical level that it is in immediate danger of extinction, that it is not a population of a species already listed in Schedule 1, and it is otherwise of significant conservation value.

Annexure “A”

Schedule 1 to the Threatened Species Conservation Act 1995 is amended as follows:

(a) by omitting the following matter in Part 2 under the heading “Birds” and

the sub-heading “Spheniscidae”:

Eudyptula minor (Forster, 1781) Little Penguin at Manly Point
(b)	by inserting in Part 2 under the heading “Birds” and the sub-heading “Spheniscidae” the matter:
Eudyptula minor (Forster, 1781) Little Penguin in the Manly Point Area (being the area on and near the shoreline from C an nae Po in t genera l ly northward to the point near the intersection of Stuart Street and Oyama Cove Avenue, and extending 100 metres offshore from that shoreline)
