HIS HONOUR:   This was a summons by the Commonwealth for summary relief against a writ and statement of claim which was filed in the Court by Mr Thorpe.  The matter was heard in Canberra, and then in Melbourne.  The orders which the Court makes are:

(1)  Written statement of claim set aside for want of jurisdiction;

(2)  Applications for precipes for the issue of subpoenas dismissed;

(3)  The plaintiff to pay the defendant’s costs.
