GAUDRON J:   This application came before a Court constituted by Justices Kirby, Hayne and myself in Canberra on Friday, 6 August 1999.  On that occasion the Court made orders granting the applicant special leave to appeal, treating the appeal as instituted and heard instanter and allowing the appeal.  Justice Hayne and I now publish our reasons for participating in those orders.
