This is an application for special leave to appeal from the decision of the Court of Appeal of the Supreme Court of Queensland (Sofronoff P) dismissing applications for an extension of time in which to apply for leave to appeal from decisions of the Appeal Tribunal of the Queensland Civil and Administrative Tribunal dismissing appeals from an adjudicator's orders under the Body Corporate and Community Management Act 1997 (Qld) that the applicant engage a specified contractor to make repairs to stop water leaking from the applicant's unit to two other units and to effect repairs to damage caused by the leaking. The applicant requires an extension of time within which to file the application for special leave to appeal.
There is no reason to doubt the correctness of the Court of Appeal's decision. An appeal to this Court would enjoy no prospect of success, and, accordingly, it would be futile to grant the extension that is sought.
Pursuant to r 41.08.1 of the High Court Rules 2004 (Cth), we direct the Registrar to draw up, sign and seal an order dismissing the application.
