Therapeutic Goods (Charges) Regulations2 (Amendment)

I, WILLIAM PATRICK DEANE, Governor-General of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, make the following regulations under the Therapeutic Goods (Charges) Act 1989.

1.   Commencement

1.1   These regulations commence on 1 August 1998.

2.   Amendment

2.1   The Therapeutic Goods (Charges) Regulations are amended as set out in these regulations.

3.   Regulation 3 (Charges)

3.1   Subparagraph 3 (1) (a) (i):

Omit “$620;”, substitute “$750;”.

3.2   Subparagraph 3 (1) (a) (ii):

Omit the subparagraph, substitute:

  • “(ii)

    if the goods are drugs other than drugs mentioned in subparagraph (i) — $455; or

  • (iii)

    if the goods are devices — $490; and”.

3.3   Paragraph 3 (1) (b):

Omit the paragraph, substitute:

  • “(b)

    for therapeutic goods (other than therapeutic goods produced for export) the listing of which is in force at any time during a financial year:

    • (i)

      if the goods are drugs — $270; or

    • (ii)

      if the goods are devices — $300.”.

3.4   Subparagraph 3 (1A) (a) (i):

Omit “$620;”, substitute “$750;”.

3.5   Subparagraph 3 (1A) (a) (ii):

Omit the subparagraph, substitute:

  • “(ii)

    if the goods are drugs other than drugs mentioned in subparagraph (i) — $455; or

  • (iii)

    if the goods are devices — $490; and”.

3.6   Paragraph 3 (1A) (b):

Omit the paragraph, substitute:

  • “(b)

    for grouped therapeutic goods (other than grouped therapeutic goods all of which are produced for export) the listing of which is in force at any time during a financial year:

    • (i)

      if the goods are drugs — $270; or

    • (ii)

      if the goods are devices — $300.”

3.7   Paragraphs 3 (2) (a) and (b):

Omit “$5,260” (twice occurring), substitute “$6,800”.

3.8   Paragraphs 3 (2) (c) to (h):

Omit “$2,690” (wherever occurring), substitute “$3,500”.

4.   Regulation 4 (Charges not payable when turnover is of low volume and low value)

4.1   Subregulation 4 (2):

Omit “5%” (twice occurring), substitute “6%”.
