An Act to amend the Theatres and Public Halls Act 1908 with respect to the holding of boxing and wrestling contests and similar entertainments. [Assented to 24 April 1986.]

Theatres and Public Halls (Boxing and Wrestling Contests) Amendment 1986
BE it enacted by the Queen’s Most Excellent Majesty, by and with the advice and consent of the Legislative Council and Legislative Assembly of New South Wales in Parliament assembled, and by the authority of the same, as follows:
Short title
This Act may be cited as the “Theatres and Public Halls {Boxing and Wrestling Contests) Amendment Act 1986”.

Commencement
2. (I) Sections 1 and 2 shall commence on the date of assent to this
Act.
| (2) | Except as provided by subsection (I), this Act shall commence on the |
day appointed and notified under section 2 (2) of the Boxing Authority Act
1986.
Amendment of Act No. 13, 1908
The Theatres and Public Halls Act 1908 is amended in the manner set forth in Schedule 1.

Saving
Notwithstanding this Act, section 27 of the Theatres and Public Halls Act 1908, as in force immediately before the commencement of this Act, continues to apply to and in respect of a boxing or wrestling contest or other display or exhibition of boxing or wrestling held within 30 days after the commencement of this Act, as if this Act had not been enacted.

(1) Section 27 (1)—

(2) Section 27 (1)—
Omit “forty dollars”, insert instead “$2,000” .
(3) Section 27 (2)—
Omit the subsection, insert instead:
(2) The Minister may, if the Minister is of the opinion that it is fitting for the preservation of good manners and decorum to do so, by a notice in writing served on the holder of a licence under the Liquor Act 1982 or a certificate of registration under the Registered Clubs Act 1976, prohibit or regulate the holding, on the premises to which the licence or certificate of registration relates, of the type of entertainment (not being boxing or wrestling), or the particular entertainment (not being a boxing or wrestling contest or other display or exhibition of boxing or wrestling), specified in the notice, whether or not that entertainment would constitute public entertainment for the purposes of this Act.
(4) Section 27 (3)—
Omit “one hundred dollars”, insert instead “$2,000” .
(5) Section 27 (5)-(14)—
Omit section 27 (5), insert instead:
(5) A female person of any age shall not take part in any boxing contest, or other display or exhibition of boxing, for which a permit is required under subsection (6).
Penalty: $2,000.
(6) Any boxing or wrestling contest, or other display or exhibition of boxing or wrestling, which a person proposes to hold—
(a) for public entertainment; or

(b) for the entertainment of—
(i) patrons of any premises licensed under the Liquor Act 1982 or registered under the Registered Clubs Act 1976; or
(ii) the public or any section of the public at any theatre or public hall, or any temporary structure within the meaning of Part III,
whether or not that entertainment would constitute public
entertainment for the purposes of this Act,
requires a permit under this subsection.
(7) A person proposing to hold any boxing or wrestling contest or other display or exhibition of boxing or wrestling for which a permit is required under subsection (6) may apply to the Minister, not less than 21 days before the date of the proposed contest, display or exhibition, for such a permit.
(8) The Minister—
| (a) | may grant a permit referred to in subsection (7) unconditionally or subject to such conditions as the Minister thinks fit to impose; or |
(b) may refuse to grant such a permit,
(9) A permit may be granted under subsection (8) so as to authorise a single contest, display or exhibition or 2 or more contests, displays or exhibitions.
(10) A person shall not hold or promote—
| (a) | any boxing contest, or other display or exhibition of boxing, in which a female person is a contestant; or |
| (b) | any contest, display or exhibition for which a permit is required under subsection (6)— |
(i) without the required permit; or
(ii) contrary to the conditions subject to which such a permit was granted.

Penalty: $2,000.
(11) The powers of the Minister under subsection (8) may be exercised by a person in accordance with the terms of an instrument in writing for the time being in force by which the Minister has delegated to the person, to such extent as the Minister has thought fit to specify in the instrument, the exercise of those powers.
(12) A delegation effected by an instrument referred to in
subsection (1 1)—
| (a) | does n^t prevent the exercise by the Minister of any delegated power; and |
| (b) | may be revoked at will by the Minister by notice in writing served on the delegate. |
(13) In this section, “boxing” has the same meaning as in the
Boxing Authority Act 1986.
(14) This section does not apply to or in respect of a boxing
contest as defined in the Boxing Authority Act 1986.
