(AMENDMENT) ACT.

and Public Halls Act, 1308-1938, in certain nc. le, 1939.

respects; and for purposes connected there­

with, [x\ssented to, 10th October, 1939.]

I 3 E it enacted by the King's ]\Iost Excellent Majesty, I I by and with the advice and consent of the Legis­ lative Council and Legislative Assembly of New South Wales in Parliament assembled, and by the authority of the same, as follows :—^

1. (1) This Act may be cited as the “ Theatres and sherttitle

Public Halls (Amendment) Act, 1939.”

(2) The Theatres and Public Halls Act, 1908-1938, as amended by this Act, may be cited as the Theatres and Public Halls Act, 1908-1939.

2. The Theatres and Public Halls Act, 1908-1938, is Amcnament

amended by inserting at the end of subsection one of

section 13a the following new paragraphs:—

Any person who after the date of His IMajesty’s assent to the Theatres and Public Halls (Amend­ ment) Act, 1939, contravenes the provisions of this subsection shall be guilty of an offence and shall be liable upon summary conviction to a penalty not exceeding one hundred pounds, with an additional penalty in the case of a continuing offence not exceed­ ing ten pounds for each day upon which the offence continues.

Where a cinematograph film is exhibited in any theatre or juiblic hall in contravention of this sub­ section, the IMinister may in his discretion, cancel the license issued under this Act in respect of such theatre or public hall. Such cancellation shall be in addition to any penalty which may be imposed under this subsection in respect of such contravention, but shall not be imposed for a first offence.
