Cancellation of registration on FWA's own motion - Theatre Managers' Association.
[1] On 9 March 2010 a hearing was held to consider an application under s.30(1)(c) to cancel the registration of the Theatre Managers’ Association (TMA).
[2] Mr Ray Callaghan (Secretary) and Mr Roy Reynolds (President) represented the TMA.
[3] It was put to Mr Callaghan and Mr Reynolds that the TMA no longer satisfied the criteria set down in Division 2, Section 19(1)(c) of the Fair Work (Registered Organisations) Act 2009 (the Act) as it no longer had 50 or more members who were employees.
[4] Section 30(1)(c) of the Act provides that Fair Work Australia may cancel the registration of an organisation on its own motion if:
“(ii) the organisation is an organisation of employees, other than an enterprise association, and has fewer than 50 members who are employees;”
[5] Mr Callaghan conceded that the TMA no longer had the requisite number of members, and did not have the potential to increase their membership. The TMA did not therefore oppose the cancellation of registration.
[6] The registration of the Theatre Managers’ Association is cancelled on and from 16 March 2010.
