CaseChat Overview and Summary

This matter concerned an application for review of a decision by Comcare, affirmed on review, which determined that Mr Theacos was not presently entitled to compensation for incapacity and medical expenses in respect of an accepted injury. The applicant, Mr Theacos, had a history of substance use disorder and alleged he suffered from major depression. The core of the dispute revolved around whether Mr Theacos continued to suffer from the accepted injury and whether his employment had ceased to contribute to a significant degree to his condition.

The court was required to determine two primary issues. Firstly, whether Mr Theacos had suffered from Major Depression at any time since 7 October 2015, and if so, the relevant periods. Secondly, if Major Depression was established, the court had to determine, on the balance of probabilities, whether Mr Theacos' employment by the ARTC had ceased to contribute to a "significant degree" to his suffering from that condition at any of those times.

The court considered the provisions of the *Safety, Rehabilitation and Compensation Act 1988* (Cth), particularly sections 14(1), 5A(1), and 5B. These sections define "injury" and "disease" for the purposes of the Act, with a disease requiring contribution to a "significant degree" by employment, where "significant degree" is defined as substantially more than material. The court also had regard to the evidence presented by Mr Theacos detailing a history of racial taunting and harassment from fellow employees and supervisors throughout his employment, commencing in 1993 and continuing in various roles. This history of alleged victimisation and discrimination was presented as the basis for his claim of major depression.
