APPLICATION FOR REVIEW
This is an application for review of a decision made by a delegate of the Minister for Home Affairs on 5 April 2018 to refuse to approve the applicant’s nomination under s.140GB of the Migration Act 1958 (the Act) and r.2.72 of the Migration Regulations 1994 (the Regulations).
The applicant applied for approval on 28 February 2018. A nomination of an occupation for a Subclass 457 visa is made under s.140GB of the Act and r.2.73 of the Regulations. Regulations 2.72(3) to (12) prescribe the criteria that must be satisfied for the Minister to approve a nomination by a person. These criteria are extracted in the attachment to this decision. For nomination applications made from 23 November 2013, additional criteria are specified in s.140GBA.
The delegate decided not to approve the nomination on the basis that the applicant did not satisfy r.2.72(10)(c) because they were not satisfied that the applicant has provided sufficient information to demonstrate that the terms and conditions of employment proposed for the nominee will be no less favourable than the terms and conditions that are provided, or would be provided, to an Australian citizen or an Australian permanent resident for performing equivalent work.
The Tribunal has considered a different issue given information referred to at paragraph 5 below. The Migration Amendment (Temporary Skill Shortage visa and Complementary Reforms) Regulations 2018 commenced 18 March 2018. As a result, the Subclass 457 visa program was repealed and closed to new applications from that date onwards
The Tribunal invited the applicant on 21 March 2019 to provide additional information in support of their case, as per s.359(A), as set out below.
‘In conducting the review, we are required by the Migration Act 1958 to invite you to
comment on or respond to certain information which we consider would, subject to
your comments or response, be the reason, or a part of the reason, for affirming the
decision under review. Please note, however, that we have not made up our mind about the information.
The particulars of the information are:
- It is a requirement for approval of the nomination that you have identified the visa
holder, applicant or proposed applicant for the visa who will work in the nominated
occupation. This requirement is in r.2.72(5) of the Migration Regulations 1994 as it
applies to your case.- A review of your file and Departmental records suggests that the person you
identified does not hold a Subclass 457 (Temporary Work (Skilled)) visa and they
do not have an application for a Subclass 457 (Temporary Work (Skilled)) that is
yet to be decided by the Department of Home Affairs or the Tribunal.- The Migration Amendment (Temporary Skill Shortage visa and Complementary
Reforms) Regulations 2018 commenced 18 March 2018. As a result, the Subclass
457 visa program was repealed and closed to new applications from that date onwards.- The Subclass 482 (Temporary Skills Shortage) visa that commenced on 18 March
2018 is not compatible with a nomination application made before then, meaning
that a Subclass 482 (Temporary Skills Shortage) visa holder cannot be relied
upon to satisfy r.2.72(5) as it applies in your case. This information is relevant to the review because it suggests that the person you identified as the proposed applicant (Zengdong XU) does not hold, and is unable to be granted, the type of visa required to work in your nominated occupation.
If we rely on this information in making our decision, we may find that that the person you identified will not work in the nominated occupation. This would be the reason, or a part of the reason, for affirming the decision under review. You are invited to give comments on or respond to the above information in writing.
Your comments or response should be received by 4 April 2019. If the comments or response are in a language other than English, they must be accompanied by an English translation from an accredited translator.
If you cannot provide your written comments or response by 4 April 2019, you may ask us for an extension of time in which to provide the comments or response. If you make such a request, it must be received by us before 4 April 2019 and you must state the reason why the extension of time is required.
We will carefully consider any request for an extension of time and will advise whether or not the extension has been granted.
If we do not receive your comments or response within the period allowed or as extended, we may make a decision on the review without taking any further action to obtain your views on the information. You will also lose any entitlement you might otherwise have had under the Migration Act 1958 to appear before us to give evidence and present arguments.’
No response to the letter was received at the time of writing this decision. As no response was received within the specified time the applicant lost their right to a hearing and the Tribunal has no power to permit them to appear. The Tribunal has decided to proceed to decision without taking further steps to obtain the information.
The applicant was represented in relation to the review by its registered migration agent.
For the following reasons, the Tribunal has decided to affirm the decision under review to refuse the nomination.
CONSIDERATION OF CLAIMS AND EVIDENCE
The issue in the present case is whether the applicant meets the criteria for approval of the nomination. The Tribunal must approve the nomination if the applicant is an approved sponsor and meets the requirements in r.2.72: s.140GB(2). The applicant must also have paid any nomination training contribution charge in relation to the nomination for which they are liable, but this liability only arises for nominations made from 12 August 2018. In addition, for nominations made from 23 November 2013, s.140GBA must be met.
Requirements for existing Subclass 457 visa holders
The criteria for approval of a nomination contain several requirements if a Subclass 457 visa holder is identified as the person to work in the nominated position. In these cases:
·the applicant must list on the nomination each person granted a Subclass 457 visa as a family member of the nominee, unless it is reasonable in the circumstances not to do so: r.2.72(6)(a) and r.2.72(7);
·the Subclass 457 visa holder must demonstrate that he or she has the skills necessary to perform the occupation in the manner specified if required to do so: r.2.72(6)(b);
·the applicant must provide a written undertaking if the existing Subclass 457 visa was granted after the sponsor provided an undertaking relating to certain health requirements: r.2.72(7A); and
·if the Subclass 457 visa holder met cl.457.223(6), he or she must either: continue to meet cl.457.223(6); or be an exempt applicant under cl.457.223(4); or have achieved in a single attempt a test score specified in IMMI 17/057 in the specified time; or, in certain cases, have proficiency of at least the standard required in order to hold a mandatory licence, registration or membership to perform the nominated occupation: r.2.72(10)(g).
As the nominee is not the holder of a Subclass 457 visa, the requirements of r.2.72(6), (7A) and (10)(g) do not apply.
It is a requirement in r.2.72(5) of the Migration Regulations 1994 for approval of the nomination that the nominator has identified the visa holder, applicant or proposed applicant for the visa who will work in the nominated occupation. This requirement applies to this case.
The person identified, Zengdong XU, does not hold a Subclass 457 (Temporary Work (Skilled)) visa and they do not have an application for a Subclass 457 (Temporary Work (Skilled)) that is yet to be decided by the Department of Home Affairs or the Tribunal.
The Migration Amendment (Temporary Skill Shortage visa and Complementary Reforms) Regulations 2018 commenced 18 March 2018. As a result, the Subclass 457 visa program was repealed and closed to new applications from that date onwards.
The Subclass 482 (Temporary Skills Shortage) visa that commenced on 18 March 2018 is not compatible with a nomination application made before then, meaning that a Subclass 482 (Temporary Skills Shortage) visa holder cannot be relied upon to satisfy r.2.72(5), as it applies in this case, because the nomination was applied for on 28 February 2018.
The person identified as the proposed applicant, (Zengdong XU), does not hold and is unable to be granted the type of visa required to work in the nominated occupation.
Therefore the Tribunal finds that the person identified in the nomination will not work in the nominated occupation.
For these reasons the requirements of r.2.72(5) are not met.
For the reasons given above, the Tribunal is not satisfied that the applicant meets the applicable criteria for the nomination to be approved. Accordingly, the decision under review must be affirmed.
DECISION
The Tribunal affirms the decision not to approve the nomination.
