Application for variation of the GeoSols Enterprise Agreement 2013.

[1] An application has been made for variation of the GeoSols Enterprise Agreement 2013 (the Agreement). The application was made pursuant to s.210 of the Fair Work Act 2009 (the Act). It has been made by The Trustee for Crighton family Trust T/A GeoSols Pty Ltd.

[2] The Association of Professional Engineers, Scientists and Managers, Australia is an employee organisation that is covered by the Agreement. It has given notice that it will not contest the variation as sought and does not otherwise wish to be heard in relation to the application.

[3] I am satisfied that each of the requirements of s.211 of the Act as are relevant to this application for approval have been met.

[4] On 14 March 2016 an undertaking was provided by the Employer. Pursuant to s.212 of the Act, I accept the Employer’s undertakings. In accordance with s.213(1) of the Act I note that a copy of the undertakings is attached to the Agreement and forms part of the Agreement.

[5] The variation to the Agreement is approved. In accordance with s.216 of the Act, the variation will operate from 15 March 2016.

[6] The consolidated version of the Agreement, as varied, is attached to this decision.
