The applicants seek special leave to appeal from a decision of the Court of Appeal of the Supreme Court of New South Wales (Basten, Gleeson and McCallum JJA) on two bases in two separate applications.
In S23/2022, the applicants seek special leave to appeal that part of the Court of Appeal's decision revoking a grant of leave to appeal and dismissing the applicants' appeal from the decision of the District Court (Gibson DCJ) on 29 October 2020. Gibson DCJ struck out certain particulars of the applicants' defamation claim against the respondents, and summarily dismissed the proceedings.
In S24/2022, the applicants seek special leave to appeal that part of the Court of Appeal's decision refusing the applicants leave to appeal against indemnity costs orders made by Gibson DCJ on 31 March 2021 consequential to the summary dismissal of the applicants' claim.
Both applications concern matters of practice and procedure. The applicants identify no question of principle which it would be in the interests of justice for this Court to consider. An appeal to this Court in either application would have no prospect of success.
Pursuant to r 41.08.1 of the High Court Rules 2004 (Cth), we direct the Registrar to draw up, sign and seal an order dismissing the applications.
