1. These regulations may be cited as The Psychological Practices Regulations, 1974.

Interpretation

2. In these regulations, unless the contrary intention appears—

"Act" means the Psychological Practices Act, 1973.

"Board" means the South Australian Psychological Board constituted by the Act.

"Recognised University" means a university declared by the Board to be a recognised

university for the purposes of the Act.

"Register" means the Register established and maintained pursuant to section 20 of the Act.

"Registrar" means the Registrar appointed and for the time being in office pursuant to

section 13 of the Act.

Registration

3. An applicant for entry of his name on the Register shall make application in the form "A" of the Schedule hereto and shall furnish to the Board all such information as is therein sought and may be required by the Board.

4. Every application for entry of name on the Register shall be accompanied by:—

(a)

a passport type photograph of the applicant;

(b)

two statutory declarations in the form "B" of the Schedule hereto deposing to the applicant’s good fame and character, the declarations being from two persons of good standing and repute;

(c)

a summary of the applicant’s experience in psychology, particularly over the three years preceding the application and including particulars of any practice in psychology in the State;

(d)

a fee of $180 which shall be refunded to the applicant if the registration sought is not obtained.

Certificate of Registration

5. The certificate issued pursuant to section 21 of the Act shall be in the form "C" of the Schedule hereto and subject to payment of a fee of ten dollars.

Renewal of Registration

6. (1) An application for renewal of registration as a psychologist must be made in the form of Form D in the schedule.

(2) The fee payable for renewal of registration as a psychologist is $160, except in the case of a psychologist who will be over 70 years of age when the period of registration commences, in which case, the fee payable is $40.

The Register

7. The Register shall be in the form "E" of the Schedule hereto and the following particulars shall be entered with respect to each registered psychologist—

(a)

his full name and address (both private and professional).

(b)

his qualifications in respect of which registration is granted.

(c)

the date of registration or renewal thereof.

(d)

particulars of any removal, cancellation or suspension of registration.

Inquiries

8. An application by any person for an inquiry into the conduct of a registered psychologist shall be in the form "F" of the Schedule hereto.

Cancellation or Suspension of Registration

9. The Registrar shall enter a note of any cancellation or suspension of the registration of any person in the Register on the day of the order of the Board for cancellation or suspension. Notice of cancellation or suspension of registration shall be given by post to the person the subject of the order at the professional address of that person appearing in the Register unless the person affected by the order of the Board was present personally or by his legal practitioner at the time any such order is made, when no notice by post shall be required.

Applications for Approval to Practise Hypnosis

10. An applicant for approval to practise hypnosis shall make application to the Board in the form "G" of the Schedule hereto.

Practice of Psychology by Unregistered Persons

11. A registered psychologist shall not employ a person who is not a registered psychologist in his practice of psychology unless the unregistered person is—

(1) (a) the holder of a degree from a Recognised University in the course of attaining which, or after attaining which, he has successfully passed such subjects in the discipline of psychology as constitute a progressional three year course of study in psychology and

(b) supervised in that practice in a manner proposed by the registered psychologist and approved by the Board as part of that unregistered person’s practical experience for registration under the Act; or

(2) a person approved by the Board as competent to practise or receive practical experience in psychology under the supervision of the registered psychologist in a manner proposed by the registered psychologist and approved by the Board.

12. A registered psychologist may authorise permit and suffer a person who is not a registered psychologist to practise psychology for him or on his behalf provided that that person is—

(1)(a) the holder of a degree from a Recognised University, in the course of attaining which, or after attaining which, he has successfully passed such subjects in the discipline of psychology as constitute a progressional three year course of study in psychology and

(b) supervised in that practice in a manner proposed by the registered psychologist and approved by the Board as part of the unregistered person’s practical experience for registration under the Act; or

(2) a person approved by the Board as competent to practise or receive practical experience in psychology under the supervision of the registered psychologist in a manner proposed by the registered psychologist and approved by the Board.

13. An unregistered person shall not practise psychology except under the supervision of a registered psychologist and in accordance with conditions proposed by a registered psychologist and approved by the Board.

Penalties

14. Any person contravening any of the provisions of these regulations shall be guilty of an offence and shall be liable upon conviction therefor to a penalty not exceeding two hundred dollars.
