An Act to further amend "The Probate and Succession

Duty Act, 1876."

HEREAS it is expedient to further amend 4i'.L'hc Probate and P m ~ m ~ e -

Succession Duty Act, 1876," in manner hereinafter provided

-Be it therefore Enacted by the Governor of the Province of South

Australia, with the advice and consent of the Legislative Council and House of Assembly of the said province, in this present Parlia- ment assembled, as follows:

1. This Act, " The Probate and Successiou Duty Act, 1876," Inco~ration.

and Act No. 225 of 1881, intituled An Act to amend the Probate and Succession Duty Act, 1876," shall be incorporated and read together as onc Act.

2. Notwithstanding anything contained in subsection 11. of Power to register in-

section 3 of Act No. 225 of 1881, the Commissioner of Inland catethatnoeucceesion

Revenue or Registrar of Probates, as the case may be, may endorse

at Predent pay-

on any instrument a certificate that no succession duty is at precent payable in respect thereof, and thereupon the Registrar-General may register such instrument; but should the succession duty be payable before the expiration of the term created by such instru- ment, both the term in such instrument and the land in respect of

which such term is created shall be liable for payment of such duty.

3. This Act may be cited for all purposes as
