1. On 19 April 2018, we made orders dismissing this application for special leave to appeal and granting leave to each party to file submissions as to the order for costs that should be made conformably with s 90(2) of the Strata Schemes Management Act 2015 (NSW).

2. Having considered the submissions filed by the respondents and the applicant's attitude to those submissions, pursuant to r 41.08.1 of the High Court Rules 2004 (Cth) we direct the Registrar to draw up, sign and seal an order in the following terms:

   1.        The applicant pay the respondents' costs.

   2.Pursuant to s 90(2) of the Strata Schemes Management Act 2015 (NSW), the costs payable pursuant to Order 1 be paid wholly from contributions levied in relation to lots other than any lot owned by the respondents.
