The proposed appeal is not a suitable vehicle for the agitation of the issues of statutory construction advanced by the applicant. The application for special leave to appeal should be refused.
Pursuant to r 41.08.1 of the High Court Rules 2004 (Cth), we direct the Registrar to draw up, sign and seal an order dismissing the application. As to the costs of the application, each party has leave to file, within seven days, submissions as to the order for costs that should be made conformably with s 90(2) of the Strata Schemes Management Act 2015 (NSW).
